What this document is
“Declaração de anuência do beneficiário da autorização de residência” is a model published by the Brazilian Federal Police (Polícia Federal, PF) under “Declarações e Formulários”. Under penalty of law, the declarant states full understanding of the document and agreement with the residence authorisation request based on Article 158 of Decree No. 9.199 of 20 November 2017.
Article 158 provides residence for victims of human trafficking, slave labour, or a rights violation aggravated by their migration status. This residence is granted for an indefinite period. The request may be sent to the Ministry of Justice by a public authority — the Public Prosecutor’s Office (Ministério Público), the Public Defender’s Office (Defensoria Pública) or the labour inspectorate (Auditoria-Fiscal do Trabalho) — and under § 4 the beneficiary must give consent to that request. This form serves that purpose. It is in Portuguese, one page, with a printed warning about Article 299 of the Penal Code.
Who files it and where
- the foreign national who benefits from the residence authorisation requested by a public authority signs it;
- if the declarant does not speak Portuguese, an ad hoc interpreter reads and translates the text into their native language and also signs;
- the declaration goes with the authority’s request; ask the authority handling your case, or the PF, how and where to hand it in.
What the form asks
- full name and nationality;
- identity document: type and number;
- address and e-mail;
- full details of the ad hoc interpreter, if one is needed;
- city, UF and date; signatures of the declarant and of the interpreter (if any).
