What this document is

“Declaração … no Brasil e no exterior, nos últimos cinco anos anteriores à data de requerimento de autorização de residência” is a template of Brazil’s Federal Police (PF). The declarant states, under penalty of law, that they have no criminal record (antecedentes criminais) in Brazil or abroad for the five years before the residence application.

The form is in Portuguese, one page; at the bottom it warns about Article 299 of the Brazilian Penal Code (false statements in a document).

Who files it and where

  • the foreign national signs the declaration personally; it is attached to the migration request to the PF with the other documents;
  • the PF page lists this template for temporary residence of a national of a neighbouring country where the Mercosur residence agreement is not in force (Portaria Interministerial MJSP/MRE nº 19/2021), marked “dispensada para menores de 18 anos” — not required under 18;
  • whether you need this exact wording is shown by the link in the document list of your procedure on the PF website.

What the form asks for

  • full name, nationality and marital status;
  • date and city of birth;
  • father’s and mother’s names (filiação);
  • city, state (UF) and date of signing; the signature is handwritten.

What to bring

  • the signed declaration;
  • your passport or other document used for the request;
  • criminal record certificates (certidões de antecedentes criminais), if they are on the list for your basis;
  • check the exact list on the PF page for your basis.

How to fill it in with FoxDocs

  1. Fill in the cards on this page — every field has a hint.
  2. The assistant takes data from your profile and asks only for what is missing; it writes the country in Portuguese itself.
  3. Download the PDF, check it, print it and sign it by hand.

Frequently asked questions

Can I fill in No record in Brazil and abroad (5 years) online?

Yes. FoxDocs fills in the original “No record in Brazil and abroad (5 years)” form online: answer cards with hints (or add a photo of a document), check the values on the form and download the PDF. You submit it yourself: Attached to the migration request to the Polícia Federal.

Does a minor need this declaration?

For this procedure the PF page says “dispensada para menores de 18 anos”: it is not required under 18.

The PF publishes several similar declarations — which one do I need?

The one linked in the document list of your procedure on the PF website. The variants differ by period (to date, last year, last five years, five years before the request) and by territory (Brazil only, or Brazil and abroad).

Does the declaration replace a criminal record certificate?

No. In the PF document lists, criminal record certificates (certidões de antecedentes criminais) and the declaration are separate items: usually both are required. Check the exact list on the PF page for your basis.

What if I do have a criminal record or case?

Do not sign a declaration with false information: the form states that a false statement is a crime under Article 299 of the Brazilian Penal Code (imprisonment and a fine). Ask the PF or a lawyer how to proceed.

Do I have to give my father’s name?

The form has the line “filho de … e de …”. If your father is not listed on your birth certificate, leave his line blank; write your mother’s name as on the certificate.

Which language do I fill it in?

The form is in Portuguese; data are written in Latin block capitals, as the form requires. FoxDocs writes the country of nationality in Portuguese for you.
