What this document is
“Declaração, sob as penas da lei, da autenticidade da certidão de nascimento ou de casamento” is a model published by the Brazilian Federal Police (Polícia Federal, PF) under “Declarações e Formulários”. The declarant states that the birth and/or marriage certificate presented is authentic, so that it is accepted without legalisation and without translation.
As a rule, foreign documents used in Brazil must be legalised or apostilled and translated by a sworn translator. The PF can accept a certificate without that only where a rule for the specific legal basis expressly allows it — and then this declaration goes with the certificate. The form is in Portuguese and one page long; it carries a printed warning about Article 299 of the Penal Code (false statements in a document).
Who files it and where
- the immigrant who attaches their birth or marriage certificate to a migration request filed with the PF signs it;
- the PF page on residence for nationals of neighbouring countries where the Mercosur residence agreement is not in force (Venezuela, Suriname, Guyana) says birth and marriage certificates are accepted without legalisation and translation if accompanied by this declaration;
- the PF answer on legalisation and translation lists similar exceptions in the interministerial ordinances on humanitarian visas and residence for nationals of Haiti (Portaria Interministerial nº 27/2021) and Ukraine (nº 28/2022);
- the PF warns that rules cannot be mixed: an exception applies only within its own legal basis; otherwise legalisation and translation are required.
What the form asks
- full name in capital letters;
- nationality and marital status;
- date and city of birth;
- names of father and mother (filiação);
- city, UF and date of signing; the signature is handwritten.
What to bring
- the signed declaration;
- the birth and/or marriage certificate itself;
- the passport or identity document used in the request;
- the other documents listed for your legal basis on the PF website; check fees and filing rules on the authority’s website.
