What this document is
“Solicitud de fraccionamiento del pago de prestaciones indebidamente percibidas” is a form of Spain’s State Public Employment Service (SEPE). It is used when SEPE has issued a decision (resolución) that unemployment benefit was overpaid (cobro indebido) and must be returned, and the person cannot pay the full amount at once.
According to the notes on the form, instalments are governed by article 33 bis of Royal Decree 625/1985 and the General Social Security Collection Regulation (Royal Decree 1415/2004).
Who files it and where
- the person who received SEPE’s decision on the overpayment;
- the form is handed in at SEPE or through the registry of another public body — it has room for both stamps;
- if the case has already been passed to the TGSS for enforced collection, the TGSS decides: SEPE forwards the request, and the plan then covers all Social Security debts with surcharges and interest.
What the form asks for
- name, surnames, DNI/NIE, Social Security number, date of birth, sex and nationality; for returning emigrants — the country and period worked abroad;
- home address and, if different, an address for notifications; phones and e-mail;
- the date of SEPE’s decision, the amount owed and the overpayment period;
- income of the applicant, the spouse and up to three children by type, and whether the spouse and children are still dependent;
- how many months to split the debt over and, optionally, an additional reason;
- place, date and the name under the signature.
The “Diligencia de documentación” table and “Observaciones” are filled in by SEPE staff.
What to bring
- DNI, passport or TIE;
- family book (libro de familia) or Civil Registry birth certificates of the family; foreigners — an equivalent document with an official Spanish translation;
- documents proving your financial situation (income, expenses, etc.).
If SEPE asks for documents, you have 10 working days to provide them; otherwise the request is treated as withdrawn.
