What this document is

“Solicitud de abono de prestaciones por desempleo devengadas y no percibidas por causa del fallecimiento de su titular” is a form of Spain’s State Public Employment Service (SEPE). When a person receiving unemployment benefit or allowance dies and some accrued amounts were never paid, an heir asks for the share due to them.

The form has one page and covers one applicant: the heir gives their own details, the deceased’s details and whether the deceased left a will.

Who files it and where

  • an heir of the deceased beneficiary — under a will or a declaration of heirs;
  • the form is handed in at a SEPE office (space for the “Sello de la Unidad” stamp) or at the registry of another public body;
  • according to SEPE’s “Cómo presentar documentos” page, documents for SEPE are also accepted through its electronic registry, at Correos post offices, at Spanish consulates and at registry assistance offices.

What the form asks

  • the deceased: name and surnames, DNI or NIE, date of death, the benefit received;
  • the applicant: given name, both surnames, DNI or NIE, Social Security number, date of birth, sex, nationality;
  • home address and, if different, an address for notices; phones and e-mail;
  • a tick: whether the deceased left a will;
  • place, date and name of the signatory.

The “Diligencia de documentación” table and “Observaciones” are completed by SEPE staff.

What to bring

  • the applicant’s DNI, passport or TIE;
  • the will (testamento) or the declaration of heirs (declaración de herederos) — both are listed on the form itself;
  • other documents proving the death and the heir’s entitlement — check the exact list with the SEPE office.

If SEPE requests documents, you have 15 days to provide them (art. 25.1 R.D. 625/1985, printed on the form); otherwise the application is filed away.

Who can submit this application?

An heir of the deceased recipient of unemployment benefit. On the form they state they act as heir and ask for the part due to them.

Which amounts can be claimed?

Amounts that had accrued to the deceased (devengadas) but were not paid before death. SEPE determines the amount and period.

What should be attached?

The will or the declaration of heirs — the form itself lists them. SEPE may request other documents separately.

What if the deceased left no will?

Tick “No ha otorgado testamento”. The heir’s entitlement is then proven by a declaration of heirs.

How long do I have to provide requested documents?

15 days from SEPE’s request (art. 25.1 R.D. 625/1985). If you miss it, the application is filed away, but a new one can be made while the right has not expired.

Where do I submit the form?
