What this document is

MS-3 (“Solicitud de prestaciones de supervivencia”) is the official form of Spain’s National Social Security Institute (INSS). One form covers every benefit after an insured person dies: widow’s pension (viudedad), orphan’s pension (orfandad), family members’ benefit (favor de familiares) and the funeral grant (auxilio por defunción). Only the sections for the benefits you claim are filled in.

If the deceased worked in the EU, Switzerland, Norway, Iceland, Liechtenstein or a country with a bilateral agreement, the form warns that a different form may apply.

Who files and where

  • the widow or widower, and also a former spouse, a spouse of an annulled marriage or a registered partner (pareja de hecho), under the conditions set out in the form’s instructions;
  • orphans — themselves or through a parent, guardian or representative;
  • relatives who lived with the deceased for the last two years and depended on them;
  • funeral grant — whoever paid for the funeral;
  • filing — online at the Social Security e-office (certificate or Cl@ve), via run.gob.es, by post or at an INSS centre (CAISS) by appointment.

What the form asks

  • the applicant, a parent/guardian or representative if any, the address and tax data for IRPF withholding;
  • the deceased: personal details, date and cause of death;
  • the deceased’s children — for the childcare benefit and the gender-gap supplement;
  • widow’s pension: relationship with the deceased (declaration), marriage or partnership dates, income, dependent children;
  • orphan’s pension: each orphan, their income and address; family members: each beneficiary and the relatives living with them;
  • bank account (BIC and IBAN), consents and signature.

What to bring

  • ID of the applicant and of everyone named in the form (DNI, TIE or passport and NIE);
  • the death certificate;
  • widow’s pension — proof of marriage or partnership; after a divorce — the court ruling and the compensatory pension document;
  • orphan’s pension — the children’s birth certificates; family members — proof of kinship and living together;
  • the full list is on the last pages of the form; check it at the office or on the Social Security website.

Frequently asked questions

Can I claim several benefits on one form?

Yes. MS-3 covers the widow’s, orphan’s and family members’ benefits and the funeral grant; you fill in the sections for what you claim.

Is an unmarried partner entitled?

According to the form’s instructions, yes, if the death occurred on or after 01/01/2008, the couple lived together for at least the 5 years immediately before the death (not required if they had children together) and registered the partnership (or formalised it before a notary) at least 2 years before the death.

What if the marriage was short?

If the death was caused by an illness that began before the marriage, the marriage must have lasted at least one year — unless there are common children or the couple lived together for a certain time before marrying (check the period with the INSS).

Can former spouses apply?

Yes, under certain conditions. INSS also asks for a declaration about the compensatory pension (a separate form).

Who gets the funeral grant?

Whoever paid for the funeral. It is decided separately from the pensions.

What if I do not consent to data checks?

Then you must bring the documents INSS asks for yourself within 10 working days.

The deceased worked abroad — what now?

For the EU, Switzerland, Norway, Iceland, Liechtenstein and treaty countries INSS uses a different form. Ask at an INSS centre.
