What this document is

MS-5 (“Solicitud de auxilio por defunción”) is the official form of Spain’s National Social Security Institute (INSS). It is used to claim a one-off payment that helps cover funeral expenses (gastos de sepelio) for whoever paid them.

If you also need a widow’s, orphan’s or family members’ pension, the form itself warns that a different model applies: MS-3 “Prestaciones de supervivencia”, which has its own funeral grant sections.

Who files and where

  • the surviving spouse, the registered partner (pareja de hecho), children and relatives who habitually lived with the deceased;
  • anyone else who paid for the funeral, with proof of payment;
  • online at the Social Security e-office (digital certificate or Cl@ve) — the form is then not signed;
  • a signed form — by post or at an INSS centre (CAISS) by appointment.

What the form asks

Seven pages: applicant details (relationship to the deceased, whether you lived together), the person acting for a minor or for someone with support measures, a representative, details of the deceased (date of death, whether a pensioner, Social Security number), language and notification address, statements, consents, bank account and signature. The last pages are instructions and data protection.

What to bring

  • DNI, NIE/TIE or passport of the applicant and, if any, of the representative;
  • the death certificate (certificado del acta de defunción);
  • spouse, partner or cohabiting relative: the family book (libro de familia) or a kinship certificate from the Civil Registry; for a pareja de hecho, proof of registration;
  • everyone else: proof of having paid the funeral (funeral home invoice);
  • documents issued abroad must be legalised;
  • a Spanish bank account (IBAN) in the applicant’s name.

Frequently asked questions

Who receives the funeral grant?

Whoever paid the funeral costs. According to the form’s instructions, it can be claimed by the spouse, a registered partner, children and relatives who lived with the deceased, or anyone else who paid for the funeral.

Can I claim it if I am not a relative?

Yes, if you paid for the funeral. In that case, attach proof of payment to the application.

How much is the grant?

The amount is set by law and is not stated on the form. Check the current amount on the Social Security website or at an INSS centre.

When will INSS reply?

According to the form, the decision deadline is 90 days from registration. If there is no reply, the claim is deemed rejected and you can file a prior complaint (reclamación previa).

What if documents are missing?

INSS will send a request, and you must provide the documents within 10 days. If identity or representation documents are not provided, the claim is treated as withdrawn.

Do I need to sign the form?

Yes, if you file it by post or at an INSS centre. When filing online at the e-office, no signature on the form is needed.

Do I need a Spanish bank account?

For payment in Spain, yes — an account in the applicant’s name (or the minor’s parent or guardian). People living abroad give a foreign account or choose payment by cheque.
