What this document is

“Declaración jurada de mantenimiento del vínculo familiar” is a template of the Spanish Ministry of Inclusion, Social Security and Migration, published with the Law 14/2013 forms (support for entrepreneurs: digital nomads, highly qualified professionals, entrepreneurs, intra-company transferees and others).

The signatory declares to the Directorate-General for Migration Management (Dirección General de Gestión Migratoria) that the family or partner relationship that gave their family member a residence permit still exists. The form cites the seventh additional provision of Law 14/2013: the conditions on which a permit was granted must be kept throughout its validity. Who files it and where

  • it is signed by the main Law 14/2013 permit holder — the person through whom the family member obtained residence;
  • the family member is a spouse or partner, a child or a parent (ascendiente), as listed in article 62.4 of Law 14/2013;
  • it is attached to the renewal application of the family member’s permit (MI-F form, “renovada”);
  • Law 14/2013 applications are handled by the Unidad de Grandes Empresas y Colectivos Estratégicos (UGE-CE); the law provides for electronic filing (article 76);
  • the form asks for the original and a copy.

What the form asks for

  • given name, two surnames, nationality, NIE and passport number of the declarant;
  • date of birth (dd/mm/yyyy), town and country of birth, father’s and mother’s names;
  • marital status — S/C/V/D/Sp boxes;
  • address in Spain, phone and e-mail;
  • full name of the family member whose permit is renewed;
  • place and date of signing, signature.

Who signs it — me or my family member?

The main Law 14/2013 permit holder: the text refers to renewing the permit of “my spouse/partner, child, parent”. The family member does not sign this declaration.

When is it needed?

When renewing a family member’s permit issued under Law 14/2013. The form is not meant for a first application — its text speaks of renewal.

What exactly do I declare?

That the family or partner relationship on which the family member obtained the previous residence permit still exists.

How do I show who this person is to me?

There are no boxes for it: strike out by hand what does not apply in “cónyuge/pareja, hijo/a, ascendiente”, as footnote 3 of the form requires.

I am renewing permits for two children. One declaration or two?

The form has one line for the family member’s name, so it is easier to fill in a separate declaration for each. Confirm the exact practice with the UGE-CE.

The relationship has ended. What now?

Do not sign the declaration. Law 14/2013 requires notifying the UGE-CE of any change in the conditions within 30 days (seventh additional provision).

Can I fill it in by hand?
