What this document is

“Declaración jurada de inactividad laboral (RD 1155/2024)” is a template of the Spanish Ministry of Inclusion, Social Security and Migration from its “Modelos de comunicaciones” section. The signatory declares to the Spanish authorities that they do not work in the companies whose shares or holdings provide their means of support.

It is required by article 62.3 of RD 1155/2024, the immigration regulation. Non-lucrative residence (residencia temporal no lucrativa) requires proof of sufficient means; if they come from shares or holdings in Spanish, mixed or foreign companies established in Spain, you need a certificate from those companies that you do not work there, plus this declaration. Who files it and where

  • a foreign national applying for or renewing non-lucrative residence who lives on income from company shares or holdings;
  • first application: together with the visa application at the Spanish consulate (article 63 RD 1155/2024);
  • renewal: together with form EX-01 at the Oficina de Extranjería — article 64 refers to the same means requirements;
  • if your means are a pension, savings or rent rather than shares, this declaration is not needed;
  • as stated on the form, file the original and a copy.

What the form asks

  • first name, two surnames, nationality, NIE (if you already have one) and passport number;
  • date of birth (dd/mm/yyyy), town and country of birth, father’s and mother’s first names;
  • marital status — boxes S/C/V/D/Sp;
  • address in Spain, phone and e-mail;
  • place and date of signing, signature.

What to bring

  • the signed declaration — original and copy;
  • the companies’ certificate that you do not work there (the declaration refers to it);
  • proof of the means themselves and the application (visa or EX-01);

When is this declaration needed?

When you apply for or renew non-lucrative residence and your means come from shares or holdings in Spanish, mixed or foreign companies established in Spain. Article 62.3 of RD 1155/2024 requires it.

What exactly am I declaring?

That you do not work in the companies whose shares or holdings provide your means. Working there would contradict the permit itself, which is for living in Spain without working.

Is the declaration enough on its own?

No. The regulation also requires a certificate from the companies that you do not work there. The declaration refers to it.

I live on a pension or savings. Do I need this form?

No. It is only needed if your means come from shares or holdings in companies.

I do not have an NIE yet. What do I write?

Leave the NIE box empty. On a first application through the consulate there is usually no NIE yet; the passport number is enough.

How many copies do I bring?

As stated on the form itself — the original and a copy.

Can I fill it in by hand?
