What this document is
“Declaración del cumplimiento de la obligación de escolarización de menores a cargo en España” is a form published by Spain’s Ministry of Inclusion, Social Security and Migration in its “Modelos de comunicaciones” section. In it a foreign national declares that the school-age children in their care in Spain are attending school.
Royal Decree 1155/2024 requires this when renewing a residence permit: non-lucrative residence, family reunification, employment and self-employment (articles 64, 71, 80, 86), and for long-term residence based on previous residence (article 184). The ministry describes the forms in this section as guidance models, not mandatory ones. FoxDocs fills in the fields of the ministry’s PDF without changing its text.
Who files it and where
- a foreign resident who has school-age children in their care in Spain;
- school age, per the form’s footnote: from the calendar year in which the child turns 6 up to age 16 inclusive;
- the declaration is attached to a renewal application (EX-01, EX-02, EX-03, EX-07) or a long-term residence application (EX-11) — on paper at the office or uploaded when filing electronically;
- if schooling is not proven, the immigration office informs the education authorities and warns in writing that the permit will not be renewed unless the child is enrolled and proof is provided within one month (this applies to renewals of non-lucrative, employee and self-employed residence and to long-term residence — RD 1155/2024, arts. 64, 80, 86, 184).
What the form asks for
- applicant’s details: given name, two surnames, nationality, NIE, passport number;
- address in Spain, phone and e-mail;
- a table for 7 children: full name, NIE, date of birth, province where the child attends school, relationship to the applicant;
- consent for the authority to verify the schooling data itself;
- place and date of signing, applicant’s signature.
What to bring
- the signed declaration;
- if you do not consent to verification — a school certificate (certificación) for each child, as the form states;
- the renewal application and the documents your procedure requires; check the exact list with the office.
