What this document is

“Declaración jurada de cónyuge o pareja para reagrupación familiar o familiares de personas con nacionalidad española” is a template of the Spanish Ministry of Inclusion, Social Security and Migration, published under “Modelos de comunicaciones”. The signatory declares to the Spanish authorities that no other spouse or partner lives with them in Spain.

It is required by article 68.3 a) 4º of RD 1155/2024 (family reunification of foreign residents) and article 96 a) 2º of the same regulation (residence for family members of Spanish nationals). The law forbids reunifying more than one spouse, even where the foreigner’s personal law allows polygamy (article 17.1 a) of LO 4/2000). Who files it and where

  • a foreign resident applying to bring a spouse or partner to Spain (EX-02, persona reagrupante);
  • a Spanish national whose spouse or partner applies for residence on that basis (EX-24);
  • it is signed by the person the spouse is joining, not by the arriving spouse;
  • it is attached to the application at the Oficina de Extranjería; the form asks for the original and a copy.

What the form asks for

  • given name, two surnames, nationality, NIE (if any) and passport number;
  • date of birth (dd/mm/yyyy), town and country of birth, father’s and mother’s names;
  • marital status — boxes S/C/V/D/Sp;
  • address in Spain, phone and e-mail;
  • place and date of signing, signature.

What to bring

Frequently asked questions

Who signs the declaration — me or my spouse?

The person the spouse or partner is joining: the foreign resident filing EX-02 or the Spanish national under EX-24, as set out in articles 68.3 a) 4º and 96 a) 2º of RD 1155/2024.

What exactly do I declare?

That no other spouse or partner lives with you in Spain. For a foreign resident’s family reunification it is also linked to the ban on reunifying more than one spouse (article 17.1 a) of LO 4/2000).

Is it needed for a partner, not a spouse?

Yes. The form and the regulation refer to a spouse or partner (cónyuge o pareja).

I am a Spanish citizen without an NIE. What do I write?

Leave the NIE box empty and write ESPAÑA as nationality. There is no separate DNI box: if you have no passport, ask the office where to write your DNI.

EX-24 already has this annex. Do I need a separate form?

The EX-24 form includes the declaration as Annex I. The separate template is handy for EX-02 or if you print EX-24 without the annex.

How many copies do I bring?

The form itself asks for the original and a copy.

Can I fill it in by hand?

Yes, in black ink in block capitals or typed, as the form requires. FoxDocs fills it in capitals straight away.
