What this document is

The Solicitud de reconocimiento de la situación de dependencia y del derecho a las prestaciones is filed with the Andalusian Social Services and Dependency Agency (ASSDA) under Ley 39/2006, the dependency law. It asks for recognition that a person permanently needs help with daily life and for care services or payments: home help, a day centre, a care home, a family carer allowance and so on.

In Andalusia the procedure follows the rule “one application, one visit, one decision”: after you apply, a professional visits the home, assesses the situation and a single decision recognises the degree of dependency (I, II or III) and the right to specific support.

Who applies and where

  • the person who needs care applies, or their representative: a parent of a minor, a guardian, a curator, or a relative with a power of attorney or written authorisation;
  • conditions per the Junta procedure catalogue: being in a situation of dependency and having lived in Spain for five years, two of them immediately before applying; for children under five, the period applies to whoever has custody;
  • where: at any public administration registry (for Junta registries, booking an appointment, cita previa, is recommended) or by post; online through the Ventanilla Electrónica de Dependencia;
  • according to the catalogue, the decision is due within 6 months; if there is no answer, administrative silence means refusal.

What the form asks for

  • applicant details: surnames, given name, DNI/NIE, date of birth, nationality, sex, NSS and NUHSA numbers, marital status, address and contacts;
  • the representative (a person or an organisation) and the type of representation;
  • residence in Andalusia, disability, rare disease, gran invalidez;
  • grounds for priority processing (under 14, aged 90 or over, ALS, palliative care, etc.);
  • care already received, how to be notified, income (for people who do not file IRPF), consent to data checks and the list of documents.

What to bring

  • always: the “Informe sobre condiciones de salud”, a health report on the official form completed by a doctor or nurse at your health centre, no older than 3 months on the day you apply;
  • proof of representation, if a representative applies;
  • copies of DNI/NIE, a padrón certificate, an INSS benefits certificate and tax returns only if you object to the authority checking that data itself;
  • a medical or official report if you tick a ground for priority processing.

Frequently asked questions

What is the “Informe sobre condiciones de salud” and where do I get it?

It is a health report on an official form, completed by a doctor or nurse at your health centre. It must be no more than three months old when you apply.

Can a foreign national apply?

Yes. Per the procedure catalogue you need five years of residence in Spain, two of them immediately before applying, and to live in Andalusia. Nationality does not matter, but your residence must be legal — the form asks about it separately.

Who can apply for an elderly relative?

A representative. A legal one is a parent of a minor, a guardian, a curator or a guardador de hecho. A voluntary one is, for example, a relative with a written authorisation signed by both the applicant and the representative.

What happens after I apply?

A professional contacts you and visits the home, assesses the situation and drafts an individual care plan (PIA) with you. One decision then sets the degree of dependency and the right to specific support.

How long does the decision take?

According to the Junta procedure catalogue, up to 6 months. If there is no answer, administrative silence means refusal.

Can the case be fast-tracked?

Yes, for the cases in section 5: applicant under 14 or aged 90 or over, ALS, a severe neurological condition, palliative care and others. Tick the item and attach a supporting report.

Do I have to state my income?

The amounts in section 8 are only for people who are not required to file an IRPF return. If you file one, it is enough to consent to the authority checking the data itself.
