What this document is

TA.0040 “Solicitud de alta/variación de datos/baja del convenio especial de cuidadores no profesionales” is the official form of Spain's General Treasury of Social Security (TGSS). A non-professional carer (cuidador no profesional) uses it to take out a special agreement with Social Security, change its details or end it.

The agreement lets someone who cares at home for a person with recognised dependency build up contributions towards a pension. According to Social Security, the contributions are paid in full by IMSERSO; you only pay extra yourself if you want to keep your previous, higher contribution base.

This is a separate form, not the general TA.0040 for the ordinary special agreement.

Who files it and where

  • the person named as carer in the resolution granting the family-care benefit (prestación económica para cuidados en el entorno familiar) and in the PIA: a spouse, a relative up to the third degree or someone close;
  • the carer needs a Social Security number (NAF/NUSS); without one, it is obtained online or with form TA.1 filed together with this one;
  • online — through the “Alta en convenio especial” service at the Sede Electrónica;
  • or on this form, completed and signed, at the TGSS in person or through a public registry.
  • Filed within 90 calendar days of the benefit being granted, the agreement runs from the grant date; filed later, from the filing date.

What the form asks

  • carer: surnames, given name, Social Security number, date of birth, NIF/NIE/passport, address, e-mail and mobile;
  • type of application: take out (alta), change of data or end (baja);
  • when taking out — the details of the person cared for, their address, dependency degree and the date the benefit was granted;
  • for grade II — full-time or part-time care and hours per week; for any grade — whether you receive the over-52 subsidy; whether you want to pay extra;
  • for a change — reason and date; for ending — the reason from the list;
  • representative (if filing), address for notifications and, if paying extra, who pays and the IBAN for the direct debit.

What to bring

  • a copy of the carer's valid identity document (DNI, NIE or passport);
  • a copy of the identity document of the person cared for;
  • a copy of the family-care benefit resolution (PIA) — not needed if you sign the data-consultation consent in section 9;
  • for a change or ending — a document proving the change or reason (except voluntary ending).

How to fill it in with FoxDocs

  1. Tell the chat, in any language, who you care for, their dependency degree and when the benefit was granted.
  2. The assistant fills in the boxes in capitals, splits dates into their cells, ticks the right boxes and skips the sections that do not apply to you.
  3. Download the PDF, check it, print, sign and file it with the TGSS.

Frequently asked questions

Who can take out this agreement?

The person named as non-professional carer in the family-care benefit resolution and the PIA: a spouse, a relative up to the third degree or someone close. No prior contribution period is required.

Who pays the contributions?

According to Social Security, IMSERSO pays the contributions under this agreement. The carer only pays an extra amount if they chose to keep their previous contribution base.

From what date does the agreement apply?

If you apply within 90 calendar days of the benefit being granted, from the grant date. If later, from the date you apply.

What do the full-time and part-time questions mean?

They are only filled in for dependency grade II: tick full-time or part-time care and, for part-time, give the weekly hours, as in the resolution.

When do I fill in section 8 with the bank account?

Only if you decided to pay extra at your own expense. You then state who pays and the IBAN for the direct debit; if the account belongs to someone else, also the holder's details.

Do I have to attach the benefit resolution?

No, if you sign section 9 — consent for the TGSS to obtain the resolution itself. Otherwise attach a copy.

When should I file an ending (baja)?

When care stops, the person dies, the benefit ends, you become covered by a Social Security scheme (for example, through a new job) or become a pensioner. Tick a pension as the reason only once its resolution has been issued.
