What this document is

TA.0040 “Solicitud de alta/variación de datos/baja de convenio especial para personas con discapacidad que tengan especiales dificultades de inserción laboral” is the official form of Spain’s General Treasury of Social Security (TGSS). With it, a person with a disability who has particular difficulty finding work takes out a special agreement (convenio especial) with Social Security, changes its details or ends it.

It is a separate form: the general TA.0040 and the TA.0040 for non-professional carers have their own models.

Who files it and where

  • a person with a recognised disability: cerebral palsy, mental illness or intellectual disability of 33% or more, or a physical or sensory disability of 65% or more;
  • they must be registered as an unemployed jobseeker (demandante de empleo) with SEPE or the regional employment service and meet the requirement of domicile and residence in Spain — the TGSS checks this itself;
  • if the person needs support measures to exercise their legal capacity, the form is filed by their legal representative (section 2);
  • the form is filed with the TGSS in person or through a registry; the agreement can also be taken out, changed or ended online via Importass.

What the form asks

  • subscriber: surnames, given name, Social Security number, date of birth, NIF/NIE/passport, address, e-mail and mobile;
  • legal representative — the same details, if they file;
  • type of application: taking out (alta), change of data or ending (baja);
  • for alta — degree and type of disability, date of registering as a jobseeker, whether you are covered by any social-protection scheme;
  • for a change — date and reason; for baja — a reason from the list;
  • address for notifications, who pays the contributions and the IBAN of a Spanish account for the direct debit.

What to bring

  • a copy of your identity document (DNI, NIE or passport);
  • the decision or certificate of the regional body (IMSERSO in Ceuta and Melilla) stating the type and degree of disability;
  • a certificate from SEPE or the regional employment service showing registration as an unemployed jobseeker;
  • a certificate of registration on the municipal register (padrón); foreigners — proof of legal and continuous residence in Spain;
  • if filed by a legal representative — proof of representation;
  • for a change or baja — a document supporting the change or reason (except voluntary baja).

Frequently asked questions

Who can take out this agreement?

A person with a recognised disability — cerebral palsy, mental illness or intellectual disability of 33% or more, or physical or sensory of 65% or more — who is registered as an unemployed jobseeker and meets the residence requirement in Spain.

Do I need a Social Security number?

Yes, a NAF/NUSS number is needed. If you have none, the form’s instructions say to get it online (“Solicitar el Número de la Seguridad Social”) or attach form TA.1 to this application.

When is section 2 on the legal representative filled in?

Only if the person has support measures to exercise their legal capacity and the application is filed by their legal representative. Proof of representation is then attached.

Do I have to give a bank account?

Yes, the instructions say section 8 is completed in all cases. The payer is usually the subscriber. Both the account holder and the payer sign, even if they are the same person.

When does the agreement end?

For a voluntary baja — on the last day of the month in which it is filed. If the reason is a pension, the agreement ends the day before the person became a pensioner.

What does “Me opongo a la consulta” mean?

The TGSS checks your identity, address and residence itself via the Data Intermediation Platform. If you object, tick the box and attach a certificate of registration on the padrón.

Can I apply online?

Yes. The Social Security model page says the agreement can be taken out, changed or ended through Importass.
