What this document is
TA.0040 is the official form of Spain's General Treasury of Social Security (TGSS) for the convenio especial: an agreement under which a person who has stopped working or receiving benefits pays contributions themselves and keeps building up periods for a pension and other benefits.
The same form is used to change, suspend, resume or end the agreement. There are specific types for Spanish emigrants and their children abroad, returnees, Swiss pension recipients, staff of international organisations and EU officials.
Who files it and where
- people who have left a Social Security scheme (job ended, business closed, unemployment benefit ended) and want to keep contributing;
- Spanish emigrants and their children living abroad, and those who have returned to Spain;
- the application goes to the Tesorería General de la Seguridad Social — check the filing channels on seg-social.es or at a TGSS office;
- anyone living abroad must appoint a representative in section 7.
Not for every agreement: carers (cuidadores no profesionales), people with disabilities, ERE (except ERE SINTEL) and traineeships have their own TGSS forms.
What the form asks
- applicant details: surnames, name, NSS, date of birth, ID document, address, e-mail and phone;
- type of application and type of agreement (one of about twenty);
- for signing up: the reason, the start of effects and the contribution base (maximum, average, minimum or your own amount);
- a representative and the address for notifications;
- who pays the contributions and a Spanish IBAN for the direct debit — taken on the last working day of the month;
- extra details for Swiss pensioners, emigrants and staff of international organisations.
What to bring
- your identity document (DNI, NIE/TIE or passport);
- for reasons marked with an asterisk — the decision reviewing or annulling the pension; for a refused pension — the refusal;
- emigrants — proof of residence and work abroad; returnees — a certificate of the return date;
- if you object to the address check via the Data Intermediation Platform — a certificado de empadronamiento;
- the full list by type of agreement is in section 12 of the form instructions.
The agreement takes effect from the day after leaving the scheme only if you apply within 90 calendar days; otherwise it starts on the application date (as stated in the form instructions).
