What this document is
IT-1 (“Pago directo de la incapacidad temporal”, model 8-002) is the official form of Spain’s National Social Security Institute (INSS). It asks INSS to pay the temporary incapacity benefit (sick leave, baja médica) directly, rather than through the employer’s payroll.
Direct payment applies in specific cases: your contract ended or you were dismissed while on sick leave, you are a domestic or agricultural worker, a company with fewer than 10 workers has handed the payment over to INSS, the employer fails to pay the benefit it owes, and others — the form lists nineteen.
Who files and where
- an employee on sick leave whose situation appears in section 3 of the form; a legal or voluntary representative may file on their behalf;
- online — at the Social Security e-office (sede.seg-social.gob.es) with a digital certificate or Cl@ve; without them — via run.gob.es;
- on paper — a signed copy by ordinary post or at a CAISS office by appointment;
- according to the form, the decision is due within 30 days of registration; with no reply in that time, the application is deemed refused (administrative silence).
What the form asks
- applicant: surnames, given name, date of birth, sex, DNI/NIE/passport, Social Security number, nationality, address, mobile phone and e-mail (the form calls the last two essential);
- legal or voluntary representative — if someone else files;
- sick-leave date, its cause (common illness, accident, occupational disease), any other sick leave in the previous 180 days;
- the direct-payment case — one of nineteen;
- tax: province of tax residence, voluntary IRPF rate; children under 26 — only if the employment contract has ended;
- IBAN of a Spanish account in the applicant’s name, or a foreign account for residents abroad, consents, place and date.
What to bring
- DNI or passport and NIE/TIE of the applicant and any representative, proof of representation;
- employer’s certificate (certificado de empresa) — except domestic workers, artists and bullfighters;
- for an accident at work or occupational disease — the AT/EP report, if not sent through the DELTA system;
- after dismissal — the conciliation record or court ruling; if the employer does not pay — the complaint to the Labour Inspectorate, court or SMAC;
- a company with fewer than 10 workers must notify the transfer of payment to INSS at least 15 days in advance;
- INSS may ask for missing documents: the form gives 10 days to provide them.
