What this document is

Modelo 145 (“Comunicación de datos al pagador”) is the official form of the Spanish Tax Agency (AEAT). An employee tells their employer (or other payer) about their family situation: children and grandchildren, parents living with them, disability and court-ordered maintenance. The employer uses it to calculate the income tax (IRPF) withheld from the salary.

The form is given to the employer, not to the tax office. It has two pages — the employer’s copy and the employee’s copy; FoxDocs prints your data on both and does not change the official PDF layout.

Who files it and when

  • an employee or pensioner — to their employer or payer;
  • before starting work or before 1 January, then whenever circumstances change; if a change increases withholding (e.g. a child no longer lives with you), report it within 10 days;
  • it is not compulsory, but without Modelo 145 the withholding may be higher than due — the difference is refunded only after the annual tax return;
  • false data is a tax offence fined by AEAT;
  • the employer acknowledges receipt in section 7.

What the form asks for

  • section 1: NIF, surnames and name, year of birth; family situation 1, 2 or 3 (and the spouse’s NIF with situation 2); disability; moving for a new job; income generated over more than 2 years received in the last 5 years;
  • section 2: children and grandchildren under 25 living with you — year of birth, year of adoption, disability, whether they live only with you (up to 4 rows);
  • section 3: parents and grandparents over 65 living with you — year of birth, disability, how many descendants they live with;
  • section 4: court-ordered compensatory pension to a spouse and child support, annual amount;
  • section 5: loan payments for a main home bought or renovated before 2013 — only if total pay from all employers is under €33,007.20 a year;
  • section 6: place, date and the employee’s signature; section 7 is completed by the employer.

What the employer may ask for

  • the completed and signed Modelo 145 in two copies;
  • ID with NIE or DNI;
  • if needed, the family book (libro de familia) or children’s birth certificates;
  • a disability certificate;
  • the court order on maintenance or spousal support.

Frequently asked questions

Where do I submit Modelo 145?

To your employer or other payer, not to the tax office. They keep it and use it to calculate the IRPF withholding.

Is Modelo 145 compulsory?

No, but without it the withholding may be higher than due; any overpayment is refunded only after the annual tax return.

When must I report changes?

With a new Modelo 145 when family circumstances change. If the change increases withholding — within 10 days; a change in your favour applies from the date you report it.

Which family situation should I choose?

1 — you raise minor children alone; 2 — married, and your spouse earns no more than €1,500 a year; 3 — any other case.

Which children should I list?

Children and grandchildren under 25 (or older with a disability) who live with you and earn no more than €8,000 a year.

What if I have more than four children?

The form has four rows; attach another copy of Modelo 145 for the fifth and following children.

Does it need a signature?

Yes, the employee signs both copies by hand; the employer acknowledges receipt in section 7.
