What this document is

C-061 (“Manifestación de disconformidad con el alta médica emitida por el INSS”) is an official form of Spain’s National Social Security Institute (INSS). With it a worker states that they disagree with the medical discharge (alta médica) issued by the INSS medical inspectorate.

The procedure covers a discharge for recovery, for improvement or for failing to attend an examination, issued by INSS after sick leave (incapacidad temporal) has lasted 365 days. A discharge from your family doctor or a mutua is challenged under different rules.

Who files and where

  • the worker, their legal representative or an authorised representative;
  • deadline: no later than four calendar days after notification of the discharge (art. 170.3 LGSS, RD 1430/2009, art. 3);
  • filing: via the Social Security Portal de Prestaciones, a signed copy by post, or at an INSS centre (CAISS) by appointment; the law also allows filing with the health service medical inspectorate or at any public registry;
  • on the day of filing or the next working day the worker must inform the employer — the form includes a separate employer’s copy for this.

What the form asks

  • 1.1 — the worker: surnames, given name, DNI/NIE/passport, Social Security number, address, phones, e-mail;
  • 1.2 and 1.3 — a legal or authorised representative, if the worker does not file personally;
  • 2 — start date of the sick leave and who was paying the benefit at discharge: employer, mutua, SEPE or INSS;
  • 3 — date the discharge was received; 4 — statements, two consents, place and date of signing, INSS province.

What to bring

  • the worker’s DNI, passport, TIE or NIE and, if a representative files, their ID;
  • for a legal representative — the court decision or the family book (for a parent); for an organisation — its CIF;
  • for an authorised representative — proof of representation;
  • optionally — recent medical reports showing you are not yet fit to work.

Frequently asked questions

How many days do I have to file?

No more than four calendar days after notification of the discharge (art. 170.3 LGSS and RD 1430/2009, art. 3). File as soon as possible.

Which discharge does this form cover?

Only a discharge issued by the INSS medical inspectorate after 365 days of sick leave. A discharge from your family doctor or a mutua is challenged differently.

What happens after filing?

If the health service inspectorate disagrees with INSS, it proposes a review within 7 calendar days and INSS answers within the next 7. If it agrees or says nothing for 11 days, the discharge takes full effect.

Is the benefit paid during the procedure?

By law, the time between the discharge and the day it takes full effect counts as an extension of the sick leave (art. 170.3 LGSS).

Do I have to tell my employer?

Yes: on the day of filing or the next working day. The form has a separate employer’s copy; you may also give it to whoever was paying the benefit.

Can I file online?

Yes, via the Social Security Portal de Prestaciones. A paper copy is signed and sent by post or taken to a CAISS by appointment.

What if documents are missing?

INSS will send a request; you must provide the documents within 10 days of notification — online, by post or at a CAISS.
