What this document is

The solicitud de nacionalidad española por residencia is the mandatory standard form for Spanish citizenship by residence, approved by the Ministry of Justice Resolution of 16 December 2021 (BOE-A-2022-788). The procedure starts only with an application on this form.

The form is in Spanish: five sheets (HOJA 1–5), each in two copies — for the administration and for the applicant. It covers the applicant and family, address, representatives, notifications, grounds, attached documents, the name and surnames for the Spanish Civil Registry and the fee payment.

Who files and where

  • a foreign national legally and continuously resident in Spain for the required period: under the form instructions, 10 years in general; 2 years for nationals of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal and people of Sephardic origin; 1 year for those born in Spain, spouses of Spaniards (married at least a year), widows and widowers of Spaniards, descendants of Spaniards and some others; 5 years for refugees, 10 for stateless persons;
  • for a child under 14 both legal representatives (or the only one) sign; from 14 to 18 the child files personally, assisted by the representatives;
  • filed online at sede.mjusticia.gob.es or on paper at any public registry office; the paper form is addressed to the Dirección General de Seguridad Jurídica y Fe Pública;
  • the fee is paid separately with form 790, code 026, in the applicant’s name; check the amount on the Ministry website.

What the form asks

  • sheet 1: name and two surnames, date and place of birth, NIE and TIE card number, year residence began, other names, nationality, marital status and spouse, minor children, sex, parents’ names;
  • sheet 2: address in Spain, phones and e-mail; legal representatives and an authorised representative, if any;
  • sheet 3: who receives notifications and how (electronically via Carpeta Ciudadana or by post) and your grounds;
  • sheet 4: the list of attached documents;
  • sheet 5: the name and surnames for the Civil Registry, fee payment date and reference, place and date; signatures by hand.

What to bring

  • your full valid passport and the previous one covering the residence period;
  • birth certificate and criminal record certificate from your country of origin, translated and legalised;
  • CCSE and DELE certificates for adults (nationals of the Spanish-speaking countries listed in the instructions are exempt from DELE);
  • TIE card or EU registration certificate and the paid form 790-026;
  • documents for your grounds listed in section 7: marriage and spouse’s birth certificates, refugee decision, documents on representatives, etc.

Frequently asked questions

Can I apply online?

Yes, through the Ministry of Justice e-office sede.mjusticia.gob.es. On paper the form is filed at any public registry office. The filled PDF helps in both cases — as the form itself or as a draft with all answers.

How many years of residence do I need?

Per the form instructions: 10 years in general, 2 for Ibero-American, Andorran, Filipino, Equatorial Guinean and Portuguese nationals and Sephardic origin, 1 year for those born in Spain, spouses and widows of Spaniards, descendants of Spaniards and some others, 5 for refugees. Residence must be legal and continuous right before applying.

Do I need to pass exams?

Adults attach the CCSE (constitution and society) and DELE (Spanish) certificates. Nationals of the Spanish-speaking countries listed in the instructions are exempt from DELE.

What is the TIE support number?

The number of the card itself, on its front: the letter E and 8 digits. It is not the NIE. An EU registration certificate shows C and the certificate number.

Why does section 8 ask about names?

You state in advance how you will be recorded in the Spanish Civil Registry: at most two given names and two surnames. This speeds up the oath and registration.

How do I pay the fee?

With form 790, code 026, in the applicant’s name. The payment date and reference (or NRC code for online payment) go into section 9. Check the current amount on the Ministry website.

How do I apply for a child?

For a child under 14 both legal representatives or the only one sign; from 14 to 18 the child applies personally, assisted by them. Their details go into section 3.
