What this document is

“Solicitud de cambio de nombre y apellidos por uso habitual (menores de edad)” is a one-page model application published by the Comunidad de Madrid on its “Cambio de nombre y apellidos” page. With it, the parents, as legal representatives, ask the Civil Registry to open a case (expediente) and allow the child’s registered name or surnames to be replaced by the ones family, school and others know the child by.

The heading still addresses “Al Sr. Juez - Encargado del Registro Civil”, wording from the former law; the Comunidad de Madrid publishes the form this way and we do not change it.

Who files it and where

  • the minor’s legal representatives — usually both parents: the form has two lines, “D.” and “y Dª.”, and the signature “solicitante/s”;
  • for a child whose birth is recorded in a Spanish Civil Registry;
  • filed at the Civil Registry of the place of residence: in person with an appointment (cita previa) or by registered mail;
  • adults (18+) have a separate “mayores de edad” model; from 16 the person may file the request personally (art. 57, Ley 20/2011). Both a name and a surname change based on habitual use are authorised by the Civil Registry officer (Encargado del Registro Civil, arts. 52 and 54, Ley 20/2011).

What the form asks

  • the Civil Registry (town) you file with — in the heading and in the line “Ante el Registro Civil de”;
  • names, surnames and DNI/NIE of both parents; the family address, phone and e-mail;
  • the child’s name and surnames, place and date of birth; point 2º — how the child is registered;
  • point 3º — the name or surnames the child uses;
  • consent to messages by SMS or e-mail, place and date of signing.

What to bring

  • the child’s full birth certificate (certificación literal de la inscripción de nacimiento);
  • evidence that the child constantly uses the new name: documents (e.g. from school) and/or witnesses;
  • the parents’ identity documents. Check the exact list for your case with the Civil Registry.

What is this form for?

For parents to ask the Civil Registry to change their child’s registered name or surnames to the ones the child actually uses.

Who signs the application?

The child’s legal representatives — usually both parents. If there is only one legal representative, the second line stays empty.

What should be attached?

The child’s full birth certificate and evidence of constant use of the new name — documents and/or witnesses.

Where and how is it filed?

At the Civil Registry of the place of residence: in person with a cita previa or by registered mail.

Which names are not allowed?

Under art. 51 of Ley 20/2011: no more than two simple names or one compound name; no name contrary to the person’s dignity or that makes identification confusing (whether the name matches the person’s sex is irrelevant here), and not the name of a living sibling with the same surnames.

How much does it cost?

The Comunidad de Madrid page does not state a fee — check with your Civil Registry.

The child is already 18 — does this form apply?

No. An adult files personally, using the “mayores de edad” model from the same Comunidad de Madrid page.

Why does the form address a “Sr. Juez”?

It is wording from the former Civil Registry law. The Comunidad de Madrid publishes the form this way, so we do not change it.
