What this document is

“Solicitud de cambio de nombre y apellidos por uso habitual (mayores de edad)” is a one-page model application published by the Comunidad de Madrid on its “Cambio de nombre y apellidos” page. With it an adult asks the Civil Registry to open a case (expediente) and authorise changing the registered name or surnames to the ones they are known by among family, at work and socially.

The heading still says “Al Sr. Juez - Encargado del Registro Civil”, wording from the previous law; the Comunidad de Madrid publishes the form as it is, and we do not change its text.

Who files and where

  • the person concerned — according to the Comunidad de Madrid page they may apply themselves if over 16; this form is for adults (minors apply through their legal representatives, with separate models);
  • someone whose birth is recorded in a Spanish Civil Registry;
  • filed with the Civil Registry where you live: in person with an appointment (cita previa) or by registered mail to the relevant Civil Registry;
  • the Comunidad de Madrid page says the Civil Registry is the right place above all for replacing the registered given name with the one used; a change of surnames is generally addressed to the Ministry of Justice — check with your Civil Registry.

What the form asks

  • the Civil Registry (town) you file with — in the heading and in the line “Ante el Registro Civil de”;
  • name and surnames as in the birth record, DNI/NIF, place and date of birth, marital status, nationality;
  • address: town, street, number, floor and door, postcode; phone and e-mail;
  • point 1º — how you are registered; point 2º — the name or surnames you use;
  • consent to messages by SMS or e-mail, place and date of signing.

What to bring

  • a full (literal) certificate of your birth record (certificación literal de la inscripción de nacimiento);
  • evidence that you habitually use the new name: public or private documents and/or witnesses;
  • the Comunidad de Madrid also suggests baptism certificates, if any, and proposing witnesses;
  • your DNI or other identity document. Check the exact list for your case with the Civil Registry.

What is this form for?

Which names are not allowed?

No more than two simple names or one compound name; no name that harms the person, confuses identification or misleads about sex, and not the name of a living sibling.

Can I change a surname the same way?

You must prove you use the surname, that it legitimately belongs to you and that the result has one paternal and one maternal surname. Such requests are usually addressed to the Ministry of Justice; check with the Civil Registry.

How much does it cost?

The Comunidad de Madrid page does not state a fee — check with your Civil Registry.

Why is the form addressed to “Sr. Juez”?

That is wording from the previous Civil Registry law. The Comunidad de Madrid publishes the form this way, so we keep it.
