What this document is

“Solicitud de cambio de nombre y apellidos por causa justa (menores de edad)” is a one-page template published by Comunidad de Madrid on its “Cambio de nombre y apellidos” page. With it the parents, as legal representatives, ask the Civil Registry (Registro Civil) to change a child’s given name or surnames for a just cause (causa justa).

It is a separate template from the “por uso” application: there are no points about the registered and the habitually used name, but two free sections — “EXPONEN” (facts and reason) and “SOLICITAN” (the name or surnames requested).

The heading still reads “Al Sr. Juez - Encargado del Registro Civil”, wording from the former law; Comunidad de Madrid publishes the form this way and we do not change it.

Who files and where

  • both parents as the minor’s legal representatives — the form has the lines “D.” and “y Dª.” and the signature “Firma solicitante/s”;
  • the child is a Spanish national: the form reads “de nacionalidad española”;
  • it is filed with the Civil Registry where the family lives, named in the heading and in the line “Ante el Registro Civil de”; check how to file (appointment, post) on the Comunidad de Madrid page or with your Civil Registry.

What the form asks

  • the Civil Registry (town) you file with;
  • each parent’s given name, surnames and DNI/NIE;
  • the family address: town, street, number, floor and door, postcode; phone and e-mail;
  • the child’s given name and surnames, place and date of birth;
  • “EXPONEN” — the facts and the just cause; “SOLICITAN” — the new name or surnames;
  • consent to SMS or e-mail notices, place and date of signing.

What to bring

  • the child’s full birth certificate (certificación literal de la inscripción de nacimiento);
  • documents supporting the reason for the change;
  • the DNI or another ID of both parents. Check the exact list for your case with the Civil Registry.

What is this form for?

For parents to ask the Civil Registry to change a minor’s given name or surnames for a just cause.

How is it different from the “por uso” application?

The “por uso” form is for a child who has long used another name and must prove it. This one is for another just cause, described in your own words under “EXPONEN”.

Who signs?

The parents as the child’s legal representatives — the form has two lines, “D.” and “y Dª.”, and the signature “Firma solicitante/s”. If there is only one legal representative, the second line stays empty.

Can I use it if the child is not Spanish?

No: the form reads “de nacionalidad española”. For a foreign child, ask the Civil Registry or the consulate of the child’s country.

What should be attached?

The child’s full birth certificate and documents supporting the reason. Check the exact list with the Civil Registry.

Where do I file it?

With the Civil Registry where you live — its town goes in the heading and in the line “Ante el Registro Civil de”. According to the Comunidad de Madrid page, you file it in person with an appointment (cita previa) or send it by registered post.

The form does not state a fee — check with your Civil Registry.

Why is the form addressed to “Sr. Juez”?

It is wording from the former Civil Registry law. Comunidad de Madrid publishes the form this way, so we do not change it.
