What this document is

EX-09 (“Solicitud de autorización de residencia temporal con excepción de la autorización de trabajo”) is the official application for a temporary residence permit for foreign nationals whose activity in Spain does not require a work permit. The form is in Spanish, three pages: two to fill in and one with instructions.

The exemption covers the cases in article 88 of Royal Decree 1155/2024: technicians, researchers and scientists invited or hired by the State, a region, a university or a research body; lecturers at Spanish universities; directors and teachers of recognised foreign cultural or educational institutions; foreign civil servants under cooperation agreements; accredited foreign correspondents; members of international scientific missions; religious ministers and members of religious orders; officers of internationally recognised trade unions and employers’ organisations; workers posted from another EU country. The permit is needed when the activity lasts more than 90 days. EX forms are filed only in the official version: FoxDocs simply writes your data into the fields of the official PDF.

Who applies and where

  • a non-EU/EEA/Swiss national whose activity falls under one of the cases of article 88; the initial application is filed by the foreign national personally, an extension by them or through a representative;
  • from abroad — at the Spanish consulate for your place of residence (a visa is issued); from Spain — at the Oficina de Extranjería of the province where the activity starts, or online through the Mercurio portal;
  • an extension is filed only through Mercurio, within the two months before the permit expires;
  • fee — form 790 code 052: item 2.1.4 for the initial permit, 2.2.4 for an extension; paid within 10 working days of filing; check the amount on the ministry’s website;
  • decision time: in Spain two months (no answer means refusal), at a consulate 15 days, for an extension three months (no answer means approval);
  • the permit lasts as long as the activity: at most one year initially, up to four years on extension.

What the form asks

  • personal data: passport, NIE, surnames, given name, sex (H/M/X), date of birth (dd/mm/yyyy), place and country of birth, nationality, marital status (S/C/V/D/Sp), father’s and mother’s names;
  • address in Spain, mobile phone, e-mail and whether you have dependent school-age children;
  • section 2: the organisation that invites, hires or posts you (name, NIF, activity, address, contacts, representative) and your position there;
  • section 3: representative filing the application; section 4: address for notifications and consent to electronic notifications (DEHú);
  • section 5: initial permit (religious minister or another case, specified) or extension;
  • place, date, signature and, at the bottom, the authority the application is addressed to (DIR3 code and province).

Documents usually needed

  • form EX-09, original and copy, filled in in capital letters;
  • a copy of the whole passport, valid for at least one year (show the original);
  • proof of your case: invitation or contract from the university or research body, correspondent accreditation, certificate from the religious entity endorsed by the ministry, etc.;
  • criminal record certificate from your country of origin or the countries where you lived in the last 5 years, and a medical certificate;
  • receipt for the 790-052 fee;
  • foreign documents with a sworn Spanish translation and legalisation or apostille; check the exact list with the authority.

Frequently asked questions

Who is form EX-09 for?

Foreign nationals who, under article 88 of the regulation, need no work permit: scientists and lecturers invited by Spanish universities and research bodies, religious ministers, accredited correspondents, foreign civil servants and the other groups listed in the law.

Do I need it for a stay under 90 days?

No. The EX-09 permit is needed when the activity lasts more than 90 days. For a shorter period a short-stay visa is issued by the consulate.

Where do I file it?

From abroad — in person at the Spanish consulate for your place of residence. If you are already legally in Spain — at the Oficina de Extranjería of the province where the activity starts, or through the Mercurio portal. Extensions — only through Mercurio.

How much does it cost?

The fee is paid with form 790 code 052: item 2.1.4 for the initial permit, 2.2.4 for an extension, within 10 working days of filing. Check the amount on the ministry’s website before paying.

How long does the decision take?

Two months in Spain, 15 days at a consulate; with no answer the application is deemed refused. For an extension it is three months, and silence means approval.

How long is the permit valid?

For the length of the activity or programme: at most one year initially, up to four years on extension if the grounds still apply.

Can a seminarian use this form?

No. Seminarians, people preparing for ministry and those who have not yet taken vows in an order are expressly excluded from this case.

What happens after approval?

If the permit is for more than six months, within a month of entry (or of notice of the extension) you apply in person for the TIE card at the police — that is form EX-17, which you can also fill in with FoxDocs.
