What this document is
EX-06 (“Solicitud de residencia y trabajo para actividades de temporada”) is the official application for a residence and work permit for seasonal employment in Spain. The current edition follows Royal Decree 1155/2024. The form is in Spanish and has three pages: two to fill in and one with instructions.
The permit is granted for four years and for a single employer; it allows work for up to nine months per calendar year. The same form is used for the yearly call-up for a new season, a change of employer, an extension of the work period and a renewal for another four years. EX forms are accepted only in the official version: FoxDocs enters your data into the fields of the official PDF without changing its layout.
Who files and where
- the employer files and signs the application — personally or through its legal representative — electronically via the Mercurio service of the Ministry of Territorial Policy;
- an initial application must be filed at least two months before work starts; a call-up for a new season (llamamiento) at least three months before;
- at the time of the initial application the worker must be outside Spain and must not be a citizen of the EU, the EEA or Switzerland;
- fees on form 790 for an initial permit: the worker pays code 052 (item 2.1.3) and the employer code 062 (item 3.4.1) if the work permit lasts six months or more; for an extension, a renewal or a change of employer, 052 (2.2.3 / 2.2) and 062 (3.4.2); payment is due within ten working days of filing;
- an initial application is decided within one month; without an answer it is deemed refused.
What the form asks for
- section 1 — the worker: passport, NIE (if any), surnames, given name, sex, date and place of birth, nationality, marital status, parents’ names, address in Spain (if any), phone, e-mail, legal representative;
- section 2 — the employer: name, NIF/NIE, business activity (mandatory), the worker’s occupation under the contract, address in Spain, contacts and legal representative;
- sections 3 and 4 — representative filing the application and address for notifications, consent to electronic notifications (DEHú);
- section 5 — what is requested: initial permit, first, second or third call-up for a season, change of employer, extension of the work period or chained contracts, renewal of the four-year permit;
- declaration of accuracy, place and date, signature and the authority the application is addressed to.
Documents usually attached
- the EX-06 form signed by the employer;
- the employer’s documents: NIF or NIE; for a company, the registered deed of incorporation and proof of the signatory’s powers;
- a written fijo-discontinuo employment contract in the official model, stating the place and type of work, season length, working hours and start date;
- a certificate from the public employment service that there are not enough local jobseekers, and proof of the employer’s means;
- the worker’s signed commitment to return home and follow the rules at the farm and in the accommodation; a full copy of the worker’s passport; proof of the accommodation provided;
- foreign documents with a sworn translation and legalisation or apostille. Check the full list for your case against the Ministry’s information sheet 23.
How to fill it in with FoxDocs
