What this document is

“Solicitud de prestación por riesgo durante el embarazo o la lactancia natural” (form 8-007) is the official form of Spain’s National Social Security Institute (INSS). It is used to claim the benefit when working conditions are a risk to pregnancy or breastfeeding and the worker cannot be moved to a safe position: the contract is suspended (employees) or the activity stops (self-employed).

Who applies and where

  • employees and self-employed workers (autónomas), foreign nationals with an NIE included;
  • important: the benefit is granted and paid by whoever covers occupational risks (for employees, the employer’s choice). If that is a mutua colaboradora, apply to it; form 8-007 is for cases where it is INSS;
  • online — on the Portal de Prestaciones (prestaciones.seg-social.es);
  • by post — a signed copy of the form;
  • in person — at a Social Security centre (CAISS) by appointment: inss.seg-social.es/cita or 91 541 25 30 / 901 10 65 70.

What the form asks

  • the applicant’s details, address, mobile and e-mail — a footnote on the form says these are essential for notices;
  • type of work: employee or self-employed;
  • reason — pregnancy or breastfeeding; date of contract suspension or end of activity, expected delivery date or child’s date of birth;
  • tax data (province, voluntary IRPF rate), co-official language, statements;
  • payment account (IBAN in the applicant’s name), consents, place and date of signing.

What to bring

The list from the form’s own “Registro INSS” sheet:

  • ID: DNI, passport, TIE/NIE (and the representative’s, if any);
  • the employer’s certificate of occupational-risk contribution bases for the month before the suspension;
  • the medical risk certificate, if INSS does not already have it;
  • the employer’s statement that no compatible post exists and notifying the suspension; for autónomas — the activity status declaration;
  • for breastfeeding — the child’s birth certificate; with a representative — proof of representation.

If documents are missing, INSS will ask for them; you then have 10 days from the notice.

Frequently asked questions

When can the contract be suspended?

According to the form’s footnote, the suspension date is always later than the INSS medical certificate of risk.

Do I apply to INSS or to a mutua?

To whoever covers occupational risks: under articles 36 and 38 of Real Decreto 295/2009 the benefit is granted and paid by INSS or a mutua colaboradora. Ask your employer; form 8-007 is filed when it is INSS.

Can a foreign worker apply?

Yes, if she works and is insured with Spanish Social Security. The form has a “DNI - NIE - Pasaporte” box.

Is the form for self-employed workers too?

Yes. Instead of the contract suspension date you give the date the activity stopped.

How long does the decision take?

The form states up to 30 days from registration or from submitting the requested documents. With no answer, the claim is deemed refused (silencio negativo).

Do I have to fill in the bank section?

The form says to fill it in when changing account, but warns that without it the benefit cannot be paid. The account must be in the applicant’s name.

What if I don’t consent to data checks?

Then you must bring the documents INSS asks for yourself within 10 working days.

How will I receive notices?

Per the form, notices about this benefit are sent electronically via the Social Security e-office, so a correct e-mail and mobile matter.

What if my job ends?

Tell INSS: the end of employment or activity ends the benefit, otherwise you may be overpaid.
