What this document is
C-005 (“Declaración de situación de la actividad”) is an official form of Spain's National Social Security Institute (INSS). A self-employed worker (trabajador por cuenta propia, autónomo) declares on their own responsibility what happens to their business while they receive a benefit.
It is required for temporary incapacity (sick leave), birth and childcare, and risk during pregnancy or breastfeeding. Its basis is the INSS Resolution of 4 February 2004 implementing art. 12 of Royal Decree 1273/2003.
Who files it and where
- a self-employed person registered in RETA who receives one of these benefits;
- deadline per the form's footnote — 15 days: from the sick-leave date (baja médica), from the suspension of activity for pregnancy or breastfeeding risk, or from the birth, start of leave or adoption, guardianship or foster-care decision;
- filing: online at sede.seg-social.gob.es (digital certificate or Cl@ve), via run.gob.es/tramites, or a signed copy by post or at an INSS centre (CAISS) by appointment;
- if a mutua manages your benefit, ask it whether it accepts this form or uses its own.
What the form asks
- applicant: full name, Social Security number, DNI/NIE/passport, address;
- whether you own an establishment (shop, workshop, office), its address, and your activity;
- which benefit the declaration is for;
- the business situation: run by a family member, an employee or another person (with their details and the company CCC), stopped, or you are in RETA without premises;
- two consents, place and date of signing, INSS province.
What to bring
- the applicant's DNI, NIE, TIE or passport;
- details of the person running the business: ID, Social Security number and, if any, the company CCC;
- the sick-leave, birth or suspension document — if requested.
