What this document is

Births in Spain are entered in the Registro Civil on declaration: the hospital reports the birth within 72 hours, and if the child was born elsewhere or no report was sent, parents have 10 days (Ley 20/2011 del Registro Civil, arts. 46–47).

Once that period has passed, the birth can only be registered by a decision in a registry case (expediente registral, art. 47.3). This form is the parents’ application to the Juez-Encargado del Registro Civil to open the case, with the public prosecutor (Ministerio Fiscal) involved, and authorise the registration of a minor’s birth.

Who files it and where

  • the child’s parents — both, or one if the other will not appear in the record;
  • the child is a minor; the form is not for adults;
  • it is addressed to the Juez-Encargado del Registro Civil and filed in person;
  • check on the Comunidad de Madrid website or with the registry which Registro Civil to go to and whether an appointment (cita previa) is needed.

What the form asks

  • father and mother: name and surnames, their parents’ names, place and date of birth, marital status now and on the day of birth, DNI (foreigners — NIE or passport), nationality, municipality and address, postcode, phone;
  • whether the parents are married to each other (the wrong answer is struck out), place and date of the marriage;
  • the child: name and surnames, place and date of birth;
  • the Registro Civil, place and date; signatures by hand.

What to bring

  • the parents’ identity documents;
  • evidence of the birth — for example a medical certificate of delivery, if you have one; the form says supporting documents are attached;
  • the parents’ marriage certificate, if they are married;
  • foreign documents are usually legalised or apostilled and translated; check the exact list with the Registro Civil.

Frequently asked questions

When do I need this form?

When the child’s birth was not declared to the Registro Civil in time: the hospital did not send the report and the parents did not declare within 10 days. After that, registration requires a case (expediente).

Can I file if the father will not be in the record?

Yes. The form allows a single parent: the father’s section stays empty and the mother signs. Recognition of paternity is a separate matter to discuss with the Registro Civil.

Is this form for adults too?

No, it is for minors. Late registration of an adult’s birth follows a different procedure — ask the Registro Civil.

Why is the marital status on the day of birth asked?

It matters for the child’s filiation entry. That is why the form asks both the current marital status and the one on the day of birth.

Why are the grandparents’ names asked?

The form asks for the names of the father’s and mother’s parents — “hijo de … y de …”. Usually only given names are written, as in birth certificates.

How much does it cost and how long does it take?

Do foreign documents need translation?

As a rule, foreign documents are filed legalised or apostilled with a Spanish translation. Check the exact requirements with the Registro Civil.
