What this document is

“Solicitud de inscripción de nacimiento fuera de plazo de mayores de edad” is a one-page application form published by Comunidad de Madrid. With it an adult asks the Civil Registry (Registro Civil) to open a file (expediente) with the participation of the public prosecutor (Ministerio Fiscal) and to authorise the registration of their birth after the legal deadline.

Under Law 20/2011 on the Civil Registry a birth must be declared within ten days (art. 47.1), and a hospital reports it within 72 hours (art. 46). Once the deadline has passed, the birth can only be registered by a decision issued in a registry file (art. 47.3).

The heading still reads “Al Sr. Juez - Encargado del Registro Civil”, wording from the previous law; the form is published that way and we do not change it.

Who files and where

  • the adult whose birth is not recorded in the Spanish Civil Registry (there is a separate form for minors);
  • it is filed with the Civil Registry named in the heading; check with it in advance which registry is competent in your case and whether you need an appointment (cita previa);
  • it is printed and signed by hand.

What the form asks

  • the Civil Registry you file with;
  • your name and surnames, document number, place and date of birth, address and phone;
  • for your father and mother: name and surnames, their parents’ names, place and date of birth, marital status now and on the date of your birth, ID document, nationality, address;
  • whether your parents married each other (SI / NO — the wrong word is crossed out), and the place and date;
  • place and date of signing.

What to bring

  • your identity document;
  • documents proving the facts stated in the application — the form itself says so (birth, identity of the parents, their marriage if any);
  • check with the Civil Registry the exact list and format (translation, legalisation of foreign documents) for your case. The form’s page does not state a fee — ask there as well.

What is this form for?
