What this document is

851F1 (“Solicitud de cita para inscripción en el Registro de Uniones de Hecho de la Comunidad de Madrid”) is the official form a couple uses to ask the Madrid regional Register of Unmarried Couples for an appointment to register their union. Two pages to fill in plus two pages of data protection information, in Spanish.

Registration makes the couple a “unión de hecho” under Madrid Law 11/2001: the union takes effect from the date of registration, and its existence is proven by a certificate from the registrar.

Who files and where

  • two people living together as a couple: both are now registered (empadronados) at the same address and live in the Madrid region (Article 1 of Law 11/2001), and for the 12 uninterrupted months before applying they were registered together at the same address — in any Spanish municipality; certificates from a couples register of another region or EU country are also accepted (Article 3 and Second Additional Provision);
  • not eligible: unemancipated minors; married people unless judicially separated; anyone already in another union; relatives in the direct line and collateral relatives up to the third degree (Article 2);
  • both partners sign; if a representative files, section 3 is completed and the annex “Autorización para presentación de solicitud” is attached;

What the form asks

  • for each partner: NIF/NIE, passport, two surnames, given name, e-mail, fax, landline and mobile phone;
  • representative (if someone else files) — the same details;
  • how to receive notifications: electronically (only if registered in the Comunidad de Madrid notification system) or by registered mail — then the address: street type and name, number, floor, door, postcode, town, province;
  • the list of attached documents — as tick boxes;
  • objection to online checks of NIF/NIE and municipal registration (if you object), place and date of signing.

What is usually attached

  • full passport or residence card of both (valid);
  • certificate of civil status of both (certificado de estado civil);
  • for an emancipated minor — proof of emancipation;
  • a municipal registration certificate if either partner was registered outside the Madrid region; a cancellation certificate if the couple was registered in another region;
  • the Comunidad de Madrid checks NIF/NIE and registration in Madrid-region municipalities itself unless you object. Confirm the exact list for your case with the register.
