What this document is
“Declaración de entrada en territorio español” is a form of the Spanish Ministry of Inclusion, Social Security and Migration from its “Modelos de comunicaciones” section. With it a foreign national tells the police when and from which country they entered Spain, why and for how long.
The duty comes from article 13 of RD 1155/2024: third-country nationals, except those of Andorra, Monaco and San Marino, who enter Spain from a state that has signed an agreement with Spain abolishing border checks and who hold no Spanish residence permit must declare their entry in person to the police. Who files it and where
- a non-EU national who came to Spain from another Schengen country — by train, car, bus or an internal Schengen flight — without a Spanish border check;
- who has no Spanish residence permit; nationals of Andorra, Monaco and San Marino are exempt;
- the declaration is filed in person at any National Police station (comisaría) within three days of entry;
- for a minor, the legal representative — a parent or guardian — fills in and signs the form.
What the form asks
- your details: given name, two surnames, nationality, NIE (if any), passport number, date of birth (dd/mm/yyyy), town and country of birth, father’s and mother’s names, marital status (S/C/V/D/Sp);
- address in Spain (a hotel or the place you are staying is fine), phone and e-mail;
- legal representative — if the applicant is a minor;
- date of entry into Spain and the country you came from;
- purpose of stay and planned length;
- place and date of signing, province, signature.
