What this document is

Recurso à Junta de Recursos da Previdência Social is the first-level appeal form (recurso ordinário) against an INSS benefit decision. It is decided by a Junta de Recursos (JR) of the Social Security Appeals Council (CRPS) — according to INSS a collegiate body not subordinate to INSS.

The editable PDF is in the “Formulários” section of the INSS website. The second level is the Câmara de Julgamento (recurso especial), which has its own INSS form.

Who files it and where

  • the insured person, or their dependant/heir, who disagrees with the INSS decision, or their representative;
  • deadline — 30 days from when you learned of the decision (INSS page “Recurso Administrativo de Benefício Previdenciário”);
  • filed online in Meu INSS: “Novo requerimento” → “Recurso Ordinário (Inicial)”, or by phone on 135; no need to visit an office.

What the form asks for

  • names of the insured person (segurado) and of the appellant (recorrente);
  • correspondence address;
  • the reason: refusal, cessation, start date, initial amount or another decision — with the benefit or case number;
  • date of return to work — only for incapacity benefits;
  • grounds of appeal — up to 20 lines; place, date and signature.

What to have at hand

  • the INSS decision letter you are appealing (benefit or case number);
  • evidence: CTPS, CNIS statement, PPP, medical records — whatever the dispute is about;
  • for a representative — their ID and proof of authority (INSS requires it).

How to fill it in with FoxDocs

  1. Answer the chat: who appeals, what exactly, benefit number, grounds.
  2. Check the cards: number on the right line, address, text of the grounds.
  3. Download the PDF, sign it and attach it to “Recurso Ordinário (Inicial)” in Meu INSS.

Frequently asked questions

Can I fill in INSS — appeal to the Junta de Recursos online?

Yes. FoxDocs fills in the original “INSS — appeal to the Junta de Recursos” form online: answer cards with hints (or add a photo of a document), check the values on the form and download the PDF. You submit it yourself: Meu INSS (“Recurso Ordinário (Inicial)”), phone 135.

What is the deadline?

30 days from the day you learned of the INSS decision, as stated on the INSS appeals page.

Where do I file it?

In Meu INSS: “Novo requerimento” → “Recurso Ordinário (Inicial)”; also through phone 135. Visiting an office is not required.

Who decides the appeal?

A Junta de Recursos of the Social Security Appeals Council (CRPS). If you disagree with its ruling, the next level is the Câmara de Julgamento.

Must I write grounds?

Yes. INSS calls the grounds (razões recursais) indispensable; supporting documents are optional but helpful.

Can I appeal as an heir rather than the insured person?

Yes. The form separates the insured person (segurado) from the appellant (recorrente); FoxDocs asks for the insured person’s name separately.

Is there a fee?

The INSS appeals page mentions no fee.

What goes in the return-to-work date?

Only if you are appealing an incapacity benefit and have already returned to work. Otherwise it stays blank.
