What this document is
The Procuração is the power-of-attorney model of Brazil’s National Social Security Institute (INSS), Annex XXII to Instrução Normativa PRES/INSS No. 128 of 28 March 2022. The grantor (outorgante — the insured person or a dependant) appoints an attorney (outorgado) and ticks the purposes: an INSS online password, proof of life at the bank, collecting benefits and arrears, applications, reviews and appeals, or another request.
Page two is the Termo de Responsabilidade: the attorney undertakes to tell INSS within 30 days of any event that cancels the power of attorney (death of the beneficiary or end of the representation). Articles 171 and 299 of the Penal Code are printed on the form.
Who files it and where
- an INSS beneficiary on whose behalf someone else acts;
- according to the INSS page «Cadastrar ou Renovar Procuração», an attorney who will collect a benefit is registered via Meu INSS: «Agendamentos/Requerimentos» → «Novo requerimento» → «procuração»; a visit to an office is usually not needed;
- a private power of attorney may use the INSS model and does not need notarial registration; a public (notarial) one is required if either party cannot read or cannot sign;
- a power of attorney to collect a benefit is valid for 12 months and can be renewed; for an application, review or appeal it lasts until the procedure ends.
What the form asks
- grantor and attorney: name, nationality, marital status, identity document, CPF, occupation and address (street, number, complement, neighbourhood, city/state, CEP);
- powers as tick boxes; for collecting payments, the reason: illness or inability to move, travel within Brazil or abroad (with the period), living abroad (country);
- place and date under the power of attorney and under the attorney’s undertaking; both signatures.
What to bring
- photo ID of the grantor and of the attorney;
- the power of attorney and the Termo de Responsabilidade;
- for illness or inability to move — a medical certificate no older than 30 days; for travel — a written travel declaration with the period;
- if the beneficiary is already abroad — an atestado de vida (valid 90 days) legalised by a Brazilian consulate or apostilled.
