What this document is

Declaração de dependência econômica e de inexistência de dependentes preferenciais is an INSS declaration. The declarant lists the people who depended financially on the deceased or imprisoned insured person (segurado instituidor) and states that no dependants with a preferential right exist.

According to INSS, dependants fall into three classes: 1 — spouse or partner and children under 21 or with a disability; 2 — parents; 3 — siblings under 21 or with a disability. A dependant in any class excludes the following classes.

Who files it and where

  • the claimant of a survivor’s pension (pensão por morte) or auxílio-reclusão, or their legal representative;
  • INSS requires a declaration that no preferential dependants exist from parents and siblings of the insured person;
  • attached to the claim in Meu INSS or handed in at an INSS office; check the procedure on the INSS site or by phone on 135.

What the form asks for

  • the insured person’s name, date of death (if deceased), ID number and address;
  • a table of dependants (up to 7 rows): name and relationship to the insured person;
  • the declarant’s name, whether they are the claimant or a legal representative, and their address;
  • place, date and signature.

What to have at hand

  • the insured person’s death certificate or proof of imprisonment;
  • proof of kinship (the insured person’s birth certificate — for parents and siblings);
  • proof of dependency: INSS asks for at least two documents from its list (e.g. shared address, the insured person’s tax return listing you, a joint account); with only one, you can request a Justificação Administrativa.

How to fill it in with FoxDocs

  1. Answer the chat: about the insured person, the dependants and yourself.
  2. Check the cards: relationship in Portuguese (MÃE, PAI, IRMÃO), dates, addresses.
  3. Download the PDF, sign it and attach it to the Meu INSS claim.

Frequently asked questions

Can I fill in INSS — dependency declaration online?

Yes. FoxDocs fills in the original “INSS — dependency declaration” form online: answer cards with hints (or add a photo of a document), check the values on the form and download the PDF. You submit it yourself: Meu INSS or an INSS office.

Who needs this declaration?

Those whose dependency on the insured person must be proven: parents and siblings. For them INSS also requires the declaration that no preferential dependants exist.

What are “preferential dependants”?

Classes in order: spouse/partner and children, then parents, then siblings. If a dependant of an earlier class exists, later classes have no right.

Does a spouse or child have to prove dependency?

According to INSS, dependency is presumed for class 1; parents, siblings, stepchildren and wards must prove it.

Which documents prove dependency?

INSS asks for at least two documents from its list — e.g. shared address, the insured person’s tax return, a joint bank account. With only one — Justificação Administrativa.

Does it work for auxílio-reclusão?

Yes, the form covers an insured person who is “falecido/recluso”. For imprisonment, the date of death is left blank.

Who signs?

The claimant or their legal representative (parent or guardian of a minor, curator) — the form has a box for each.

What if the information is false?

The form warns of criminal liability under art. 299 of the Brazilian Penal Code.
