What this document is

หนังสือมอบอำนาจ (ท.ด. 21) is the standard power of attorney form of Thailand’s Department of Lands (กรมที่ดิน). This version has the subject “แบ่งแยกในนามเดิม” — subdivision under the same name — printed on it. It is used when the owner wants one plot with a โฉนด title deed split into several plots, each with its own title deed, while all of them stay in the owner’s name. Nothing is sold or given away by this registration.

The printed text authorises the agent to apply for the survey and subdivision, bring the surveyor, place boundary markers and certify the boundaries, agree to correct the map and area if the survey shows a difference, amend the application if needed, register the subdivision, pay the survey deposit and collect back what remains, receive the title deeds and make statements to the officer. The form records the land as shown on the title deed: map sheet, land number, survey page, deed number, sub-district, district and province. It is filled in in Thai.

Who makes it

  • the principal (ผู้มอบอำนาจ) — the owner of the land named on the title deed; if the deed names several owners, check with the office whether each of them has to grant a power of attorney;
  • the agent (ผู้รับมอบอำนาจ) — the person who goes to the Land Office and attends the survey;
  • two witnesses who certify the principal’s signature or fingerprint.

What the form asks for

  • place and date (year in the Buddhist Era, พ.ศ.);
  • land details from the โฉนด title deed;
  • name, age, race, nationality, parents’ names, address and phone of the principal and of the agent;
  • additional powers, only if needed;
  • signatures of the principal and two witnesses and the Thai ID number — by hand.

  • copies of the principal’s ID card and house registration (or a foreigner’s passport), signed by the principal;
  • the agent’s ID card or passport;
  • a sketch of how the plot is to be divided — if the office asks for it.

The exact list, survey fees, the deposit and the time needed are not stated on the form — check with the Land Office (สำนักงานที่ดิน) where the land is registered. If the land is to be divided into many plots for sale, separate land allocation rules may apply — ask the office.
