What this document is

āļŦāļ™āļąāļ‡āļŠāļ·āļāļĄāļāļšāļāļģāļ™āļēāļˆ (āļ—.āļ”. 21) is the standard power of attorney form of Thailand’s Department of Lands (āļāļĢāļĄāļ—āļĩāđˆāļ”āļīāļ™). This version has the subject “āđāļšāđˆāļ‡āļ—āļĢāļąāļžāļĒāđŒāļŠāļīāļ™āļĢāļ°āļŦāļ§āđˆāļēāļ‡āļ„āļđāđˆāļŠāļĄāļĢāļŠâ€ — division of property between spouses — printed on it. With it one of the former spouses (principal) authorises another person (agent) to register the division of the plot at the Land Office: file the application, give statements to the officer and sign until the registration is completed.

The printed powers text states that the plot is put in the name of the stated former spouse because the marriage has ended and the divorce has been registered. The form records the land as shown on the title deed (āđ‚āļ‰āļ™āļ”): map sheet, land number, survey page, deed number, sub-district, district and province. The form is filled in in Thai.

Who takes part

  • the principal (āļœāļđāđ‰āļĄāļāļšāļāļģāļ™āļēāļˆ) — one of the former spouses, a party to the division;
  • the agent (āļœāļđāđ‰āļĢāļąāļšāļĄāļāļšāļāļģāļ™āļēāļˆ) — the person who goes to the Land Office;
  • the former spouse who will hold title — named in the powers text (this can be the principal themself);
  • two witnesses who certify the principal’s signature or fingerprint.

If the agent is the other former spouse or represents them, the note on the form requires adding consent that the agent acts both in his or her own name and on behalf of the other party.

What the form asks for

  • place and date (year in the Buddhist Era, āļž.āļĻ.);
  • land details from the āđ‚āļ‰āļ™āļ” title deed;
  • name, Thai ID number, age, race, nationality, parents’ names, address and phone of the principal and of the agent;
  • the title (āļ™āļēāļ‡ / āļ™āļēāļĒ) and name of the person who will hold title;
  • additional powers — if needed;
  • signatures of the principal and two witnesses — by hand.

Documents usually attached

  • the original title deed (āđ‚āļ‰āļ™āļ”āļ—āļĩāđˆāļ”āļīāļ™);
  • divorce documents — the divorce certificate (āđƒāļšāļŠāļģāļ„āļąāļāļāļēāļĢāļŦāļĒāđˆāļē) or divorce registration record, and the property division agreement if there is one;
  • copies of the principal’s ID card and house registration, signed by the principal;
  • the agent’s ID card or passport.

The exact list, fees, taxes and processing time are not stated on the form — check with the Land Office (āļŠāļģāļ™āļąāļāļ‡āļēāļ™āļ—āļĩāđˆāļ”āļīāļ™) where the land is registered. Under Thai law a foreigner generally cannot acquire land, so check in advance in whose name the land can be registered.

How to fill it in with FoxDocs

  1. Open the chat on this page and describe the situation in any language: who is the principal, who will act as agent, which plot and in whose name it will be registered.
  2. Send photos of the title deed and ID cards or answer the questions — the assistant writes the data in Thai script and converts the year to āļž.āļĻ.
  3. Check the fields and download the PDF.
  4. Print it, sign it before two witnesses and hand it to the agent with the title deed, divorce documents and copies.

Frequently asked questions

What is this power of attorney for?

It lets another person register, on behalf of one of the former spouses, the division of a chanote land plot after divorce at a Thai Land Office.

Can it be used before the divorce?

The printed text states that the divorce has already been registered. If the marriage has not ended, a different form is needed — check with the Land Office.

Can it be used for land with an āļ™.āļŠ.3 certificate or for a condominium unit?

In which language is the form filled in?

In Thai: names, addresses and land details are written in Thai script as in the title deed and Thai documents; the year is in the Buddhist Era.

Are witnesses needed?

Yes, the form has places for two witnesses who certify the principal’s signature or fingerprint.

Can the other former spouse be the agent?

Yes, but then the note on the form requires adding consent that the agent acts both in his or her own name and on behalf of the other party.

How much does registering the division cost and how long does it take?

The form does not state fees, taxes or processing time. Check with the Land Office where the land is registered.
