What this document is

Form NJ.2 (แบบ นจ.2, "Application Form for bringing foreign worker to work with employer in the Kingdom of Thailand") is the request a Thai employer submits to the Department of Employment (Ministry of Labour) to bring foreign workers into Thailand through the MOU (government-to-government) channel. This version is for workers of Vietnamese nationality.

In the form the employer states how many workers are needed and for which work, names the recruitment company in Vietnam it has appointed by power of attorney, and gives the place of work and the main employment terms.

Who files it and where

  • the employer in Thailand (a company or an individual) fills in and signs the form;
  • it is filed with the Department of Employment — in Bangkok and in the provinces the competent office may differ, so check which office accepts MOU applications for your place of work;
  • fees, processing times and the current procedure are not stated on the form — check with the office.

What the form asks for

  • employer: name, type of business, address, telephone and fax;
  • the authorized recruitment company in Vietnam: name, address and the date of the power of attorney;
  • number of workers by type of work (labourer, domestic worker, mechanic on a fishing vessel, other) and by sex;
  • required age, height and weight;
  • address of the place of work, period of employment, wage (per day or per month), normal working hours, weekly holiday, annual leave and Thai official holidays;
  • the immigration checkpoint through which the workers will enter and the province of the Post-Arrival and Repatriation Center where they receive training;
  • date and signature of the employer.

Documents usually attached

The official file of this form also contains the documents that go with it: a power of attorney to the Vietnamese recruitment company (with a 10-baht duty stamp), a sample employment contract in Thai and English, a general power of attorney, the employment certification form WP.46 and a name list of Vietnamese workers. Company documents of the employer are normally required as well.

The exact list depends on the office and may change — check with the Department of Employment before filing.

Which language to use

Are there fees and how long does it take?
