What this document is

This is the employment contract template published by the Thai Department of Employment (Ministry of Labour) for hiring workers who are nationals of Myanmar under the Memorandum of Understanding (MOU) between Thailand and Myanmar on the employment of workers. The text is given in three columns — Thai, English and Myanmar — and all three versions are equally authentic.

The employer and the worker fill in the parties, the position, the wage and pay day, the term of the contract, the worksite, working hours, weekly days off, holidays, annual leave and overtime rates. The remaining clauses (food, accommodation, medical treatment, travel, obligations, termination, evacuation) are printed in the template.

Who signs it and where it is used

  • it is signed by the Thai employer (an individual or a company) and the Myanmar worker, in front of two witnesses, in two copies — one for each party;
  • the contract is part of the documents for bringing a worker to Thailand under the MOU; it is usually prepared by the employer or a licensed recruitment agency and submitted with the employer's request to the Department of Employment (in Bangkok — an area office, elsewhere — the provincial employment office);
  • the exact set of documents, the procedure, fees and timelines are set by the Department of Employment and the Myanmar side — check them with the office before filing.

What you fill in

  • place and date of the contract;
  • employer: name, address and the person who signs;
  • worker: full name as in the passport or Certificate of Identity, home address in Myanmar, position;
  • wage rate and unit (hour, day or month), pay day;
  • duration of the contract (months or years, counted from arrival in Thailand) and the worksite;
  • normal working hours, working days per week, weekly days off, holidays, annual leave, overtime and holiday pay rates.

Attachments

The contract form itself does not list attachments. The documents filed together with it (the employer's request, a power of attorney, a list of workers and others) are defined by the Department of Employment — check the current list with the office.

Which language to use

Each value is printed in all three columns, so FoxDocs fills it in Latin capital letters: the worker's name as in the passport, the employer and addresses in transliteration, numbers in digits; the Thai column shows the date in the Buddhist Era. Ask the office in advance whether it accepts this or needs the Thai column in Thai script.

The agreed terms must not be worse than the Thai Labour Protection Act and the minimum wage of the province of work.

No. The wage and other terms must comply with Thai labour law, including the minimum wage of the province where the worker works.

How long can the contract be?

The form leaves the term to the parties (in months or years from the day of arrival in Thailand). Limits under the MOU and the procedure for extension — check with the Department of Employment.
