What this document is

WP.26 (บต.26) is an application to the Department of Employment (DOE), Ministry of Labour, for a work permit or for the renewal of a current one for a foreigner under Section 63 of the law on managing the employment of foreigners.

Section 63 concerns foreigners who are subject to deportation: those allowed to work at a certain place instead of being deported or while awaiting deportation, and those permitted to remain in Thailand while awaiting removal. The types of work such persons may do are set by the authorities — check with the office.

The form is bilingual (Thai and English) and has 4 pages: applicant details, address in Thailand, the document permitting stay, previous or current work permit, the work, the employer, the place of work, the period applied for and a checklist of attached documents.

Who files it and where

  • a foreigner who holds a government certificate allowing work instead of deportation, or a permission to remain in Thailand while awaiting deportation;
  • the form is signed by the applicant; whether an employer or attorney may submit it on the applicant’s behalf — check with the office;
  • it is submitted to the Department of Employment: in Bangkok — the office for foreign workers or an area employment office, in other provinces — the provincial employment office;
  • the fee and processing time are not stated on the form — check them with the office.

What the form asks for

  • type of application — new permit or renewal;
  • title, name, nationality, date of birth, age, address in Thailand, phone, e-mail;
  • the document permitting stay (government certificate or permission to remain while awaiting deportation), its number, date of issue and validity;
  • previous or current work permit;
  • type and nature of work, professional licence if the law requires one;
  • employer and its address, place of work, period applied for;
  • ticks for attached documents, date and signature.

Documents listed on the form

  • copy of the government certificate on deportation status, or copy of the permission to remain while awaiting deportation;
  • copy of permission to move outside Bangkok or the province (if any);
  • copy of a professional licence (only where the law requires one);
  • Employment Certification Form from the future employer stating why a Thai national is not employed;
  • medical certificate (sound mind, no prohibited diseases);
  • three 3×4 cm photos — for a new application; the work permit — for a renewal;
  • employer documents: for an individual — ID, passport or Certificate of Residence and a business licence if any; for a company — its registration certificate or licence showing the business type.

The exact list may differ by office — check it before submitting.
