What this document is
An official form of Spain’s Public Employment Service (SEPE) for a special case of capitalising the unemployment benefit (pago único): you work on a permanent contract (contrato indefinido) for a cooperative or sociedad laboral and become a worker-partner (persona socia trabajadora) of it. The form states that the applicant must be employed under article 10.1 of Law 5/2011 on the Social Economy.
The benefit can be paid as a lump sum towards your capital contribution, monthly as Social Security contributions, or both. If you choose only one of the first two, you cannot ask for the other later.
Who applies and where
- an employee with a permanent contract in force who becomes a partner of the same cooperative or sociedad laboral;
- according to SEPE, you must meet every condition for the contributory benefit except being unemployed; the benefit claim and the pago único are filed together;
- you must not have received a pago único in the previous four years;
- if the cooperative’s statutes set a trial period for partners, the money is paid once the governing board (consejo rector) confirms you passed it;
- you can file through the SEPE e-office (sede electrónica), at a benefits office with an appointment (cita previa), at any public registry or by administrative post.
What the form asks
- how to be paid: lump sum, contributions or both;
- what you are joining: a sociedad laboral or a cooperative;
- personal details: name, two surnames, DNI or NIE, Social Security number, date of birth, sex, nationality; for returning emigrants, the countries where you worked;
- home address and, if different, a notification address; phones and e-mail;
- the bank and IBAN of an account you hold;
- place, date and signature on page two.
What to bring
- the signed form;
- ID: Spaniards — DNI or passport; EU citizens — passport or national ID plus the registration certificate with NIE; other foreigners — TIE;
- a certificate from the cooperative’s governing board or the sociedad laboral’s management body: your request to join, the terms and the contribution amount;
- your last two payslips (nóminas);
- a project report (memoria explicativa) if the entity was set up earlier but has not started trading yet;
- proof of account ownership and, if filing through a representative, proof of representation.
Per the form, within one month of receiving the money you must give SEPE proof that you became a partner and paid your capital contribution. If SEPE asks for documents, you have 15 days to provide them.
