SEPE request to withdraw, renounce or suspend the unemployment benefit

The “Solicitud de desistimiento, de suspensión o de renuncia del derecho o de la modalidad de pago de las prestaciones por desempleo” is a form of Spain’s State Public Employment Service (SEPE). With one form you ask for one of four things: withdraw a submitted unemployment benefit application, renounce a benefit already granted, renounce the lump-sum (pago único) or accumulated advance payment (abono acumulado y anticipado), or suspend the benefit so as not to combine it with employment as a complemento de apoyo al empleo (CAE).

• the applicant for or recipient of the unemployment benefit;
• only an application that has not yet been decided can be withdrawn;
• the form is handed in at a SEPE office or through the registry of another public body — the form has space for both stamps; check sepe.es for online filing.

• given name, both surnames and DNI or NIE;
• one of the four “SOLICITO” options;
• to withdraw — the date of the application and the office where it was filed; to renounce — the date it takes effect and, for a payment method, which one;
• remarks (optional), place, date and the name under the signature.

The lower half of page 1 (decision, staff signatures) is completed by SEPE.

• DNI, passport or TIE and a document showing your NIE;
• if SEPE asks — documents explaining the request; check the list at the SEPE office.

• after withdrawing, if you need the benefit again you must file a new application; if it is filed late, the days of delay are deducted from the benefit;
• after renouncing the benefit you cannot resume or extend it or later claim the subsidio por agotamiento, and the contribution periods used will not count for future benefits;
• renouncing is not possible or is void if the benefit is offsetting an overpayment, is under seizure or withholding (unless whoever ordered it agrees), or a sanction procedure has started — until the sanction is enforced;
• if you renounce the pago único you must repay any amount received, and you cannot apply for a new pago único for 4 years;
• the abono acumulado y anticipado can be renounced only before the date of the first payment;
• after suspending the benefit to opt out of CAE, resuming it requires proof of a new legal situation of unemployment.
