What this document is
OAR-01 («Solicitud del estatuto de apátrida en España») is the official form a person without any nationality uses to ask Spain to recognise them as stateless under the 1954 Convention relating to the Status of Stateless Persons. The procedure is governed by the Reglamento de reconocimiento del estatuto de apátrida (RD 865/2001) and handled by the Oficina de Asilo y Refugio (OAR) of the Ministry of the Interior.
The form is in Spanish and has four pages: personal details and address, family and countries of residence, entry into Spain, questions on nationality and protection, reasons, and a checklist of attached documents. It must be filled in in capital letters.
Who applies and where
- a person in Spain who is not a national of any country; for a minor, the legal representative applies;
- it is filed in person at any of the three places listed in RD 865/2001 (art. 2.3): the Oficina de Asilo y Refugio, a police station (comisaría) or an Oficina de Extranjería;
- under art. 4 of RD 865/2001 the application is filed within one month of entering Spain, unless your legal stay is longer; if the reasons arose later, within one month of them arising;
- under art. 11 a decision is due within three months; without an answer, the application may be deemed refused;
- a provisional stay may be authorised while the case is processed (art. 5); once recognised, a stateless person may live and work in Spain and receives a card and a travel document valid for two years (art. 13).
What the form asks
- identity document (if any), NIE, given name and two surnames, sex, date and place of birth, marital status, other names, native language, education;
- address in Spain for notifications, phones and e-mail; legal representative's details for a minor;
- family table: parents, grandparents, spouse, children — name, date and country of birth, nationality;
- countries where you lived before Spain and your status there; date, place and type of entry into Spain;
- UN protection, earlier applications for refugee status, nationality or stateless status and their outcome;
- reasons — a detailed account of why you have no nationality — and ticks for the attached documents.
What to bring
- the completed and signed form plus a copy — the copy is stamped as proof of filing;
- passports and other identity documents, even expired — copies plus originals for checking;
- birth, marriage and other civil certificates, documents of your parents, spouse and children;
- papers on loss or refusal of nationality, consulate replies, municipal registration (empadronamiento);
- if you have no documents — a written explanation of why (required by art. 3 of RD 865/2001);
- a recent photo; check the exact list for your case where you file.
