What this document is

Modelo 790 código 006 is the Spanish Ministry of Justice form used both to request a certificate and to pay its fee (autoliquidación). It covers three certificates: criminal record (antecedentes penales), last wills of a deceased person (últimas voluntades — whether a will was made and before which notary) and life insurance contracts covering death (seguros de cobertura de fallecimiento).

The form is in Spanish and has three identical copies: for the administration, for the applicant and for the bank. Several certificates can be requested on one form, but only about the same person.

Who submits it and where

  • criminal record: the person concerned or their representative; last wills and insurance: a relative, heir or other interested party after the death;
  • first the fee is paid at a collecting bank (entidad colaboradora), which returns the copies “para la Administración” and “para el interesado” stamped as paid;
  • in person — at a Gerencia Territorial de Justicia or the Oficina Central de Atención al Ciudadano in Madrid;
  • by post: criminal record — to the nearest Gerencia Territorial de Justicia or the Oficina Central (Sección de penales, Madrid); last wills and insurance — to the Registro de Actos de Última Voluntad, Plaza de Jacinto Benavente, 3, 28012 Madrid;
  • last wills and insurance certificates can be requested only after 15 working days from the death (the day of death, weekends and holidays are not counted);
  • the criminal record certificate can also be requested online at sede.mjusticia.gob.es with electronic ID (Cl@ve, DNIe or an electronic certificate); this paper form is for submission in person or by post.

What the form asks

  • section 1: ID, surnames and name of the applicant, address for notices, optionally mobile and e-mail to receive the criminal record certificate by SMS or e-mail with a download code;
  • which certificates (17, 18, 19) and, if it is for use abroad, the country and authority;
  • section B (criminal record): ID, surnames, name, date and place of birth, nationality, parents’ names and purpose;
  • section C (deceased): ID, surnames and name of the deceased, date and place of death, date and place of birth; for last wills — what is known about the will and spouses;
  • place and date, consent to postal delivery of the criminal record certificate, fee amount and payment method; signature by hand.

What to bring

  • all three copies to the bank; after payment the “Ejemplar para la Administración” goes to the Ministry;
  • criminal record: a valid ID of the person concerned (DNI, residence card, passport or Spanish driving licence); through a representative — also the ID of the represented person and proof of representation;
  • certificates on a deceased person: the death certificate is mandatory if the death was before 2 April 2009 or is registered at a juzgado de paz; for a death abroad — legalised and translated;
  • for use abroad the certificate must be legalised or apostilled, except negative criminal record certificates of Spanish citizens used in other EU states.

Frequently asked questions

Which certificates can I request with this form?

Three: criminal record, last wills of a deceased person (últimas voluntades) and their life insurance contracts covering death. One form covers certificates about one person only.

Why does FoxDocs ask for the Nº de Justificante?

The Ministry issues a unique number with every download and forbids copying the form. Download yours at sede.mjusticia.gob.es and give the number in the chat — FoxDocs prints it on all three copies.

When can I request the last wills certificate?

Only after 15 working days from the death; the day of death, weekends and holidays do not count. The same applies to the insurance certificate.

How much does it cost?

The applicant writes the 790-006 fee on the form; for several certificates, the total. Check the current amount on the Ministry website on the day you pay: FoxDocs does not fill it in for you.

Do I need the death certificate?

Yes if the death was before 2 April 2009, is registered at a juzgado de paz or happened abroad (then legalised and translated). Otherwise it is recommended.

Can I get the criminal record certificate without going back?

Yes: give a mobile number or e-mail to receive a download code, or agree to postal delivery. With Cl@ve the whole request can be done online.

I need it abroad — anything else?

Fill in the country and authority in section A. For use abroad the certificate is legalised or apostilled, except negative certificates of Spanish citizens used in the EU.
