What this document is

“Comunicación de desplazamiento por traslado intraempresarial ICT UE” is a model of Spain's Ministry of Inclusion, Social Security and Migration for mobility within the EU under Directive 2014/66/EU. With it, a company declares to the Spanish authorities that its non-EU employee holds an ICT-EU residence permit issued by another EU country and is being transferred to Spain.

Under article 73.3 of Law 14/2013 (printed on page 2 of the form), companies established in other EU countries may send such a worker to Spain for the validity of the permit after notifying the Unidad de Grandes Empresas y Colectivos Estratégicos. Who files it and where

  • the notice is filed by the company in another EU country that sends the worker; its representative signs — an administrator, director or attorney;
  • the worker is a manager, specialist or trainee employee with a valid ICT-EU permit from the first EU country;
  • it is addressed to the Unidad de Grandes Empresas y Colectivos Estratégicos (UGE-CE);
  • according to the UGE, all Law 14/2013 filings, notifications included, are submitted electronically only, through the ministry's sede electrónica; an electronic certificate is required.

What the form asks for

  • the signatory: name, DNI/NIE/passport and the capacity in which they represent the company;
  • the name of the company giving notice;
  • the expiry date of the ICT-EU permit and the EU country that issued it;
  • the worker's category: manager, specialist or trainee employee;
  • the worker's details: name, two surnames, nationality, NIE (if any), passport, date and place of birth, parents' names, marital status, address in Spain, phone, e-mail;
  • the receiving entity in Spain and the planned duration;
  • place and date of signing, signature.

What to have ready

  • the completed and signed form, to upload to the sede electrónica;
  • the worker's passport and ICT-EU card from the first EU country: the numbers, dates and category come from them;
  • check the UGE website for any other documents to attach — the form itself contains no list.

Who files this notice?

Which workers is it for?

Non-EU nationals who already hold an ICT-EU permit from another EU country as a manager, specialist or trainee employee and are transferred to a company of the same group in Spain.

Where and how is it filed?

With the Unidad de Grandes Empresas y Colectivos Estratégicos. According to the UGE, only electronically through the ministry's sede electrónica, with an electronic certificate.

Can Spain object to the transfer?

Yes. Under article 73.3 of Law 14/2013 as printed on the form, the Directorate-General for Migration may object with reasons within 20 days if the conditions are not met, the documents were obtained fraudulently or forged, or the maximum transfer period has passed.

How long can the transfer last?

Under the same article, at most 3 years for managers and specialists and at most one year for trainee employees.

What goes in the NIE box?

If the worker has already been issued an NIE, enter the full number (X0000000T). If not, the NIE box is left empty: the passport number goes in its own box.

How is this different from form MI-T?

MI-T is the application for a permit granted by Spain under Law 14/2013. This notice is filed when the ICT-EU permit has already been issued by another EU country.
