What this document is
EX-23 ("Solicitud de tarjeta (art. 18.4 del Acuerdo de Retirada)") is the official application form for the foreigner identity card (TIE) marked "art. 50 TUE". It is for UK nationals and their family members who were living in Spain before 31 December 2020 and are therefore protected by the UK–EU Withdrawal Agreement. The form is in Spanish and has three pages: two to fill in and one with instructions.
According to the Ministry of Inclusion, once the EU's EES and ETIAS systems are running, the TIE "art. 50" is the document that proves Withdrawal Agreement status at the border; the old registration certificate or family member card is not enough. Who files it and where
- UK nationals holding the green EU citizen registration certificate (certificado de registro) — exchange it for a TIE in a single police appointment;
- family members of a UK national (non-UK citizens) holding an EU family member card — exchange it the same way;
- people who never had a certificate or card first apply with EX-20 or EX-21 at the Oficina de Extranjería and, once approved, file EX-23 with the police; the Ministry's guide gives one month from notification;
- in person only, at the police with an appointment (cita previa, "Policía — toma de huellas (expedición de tarjetas)" on sede.administracionespublicas.gob.es); you also collect the card in person with a valid passport;
- the fee is paid with form 790 code 012, ticking "Certificado de registro de residente comunitario o Tarjeta de residencia de familiar de un ciudadano de la Unión"; check the amount on sede.policia.gob.es.
What the form asks
- personal details: passport, NIE, surnames, first name, sex (H/M/X), date of birth (dd/mm/yyyy), place and country of birth, nationality, marital status (S/C/V/D/Sp), father's and mother's names;
- address in Spain, mobile phone and e-mail;
- legal representative (if any), representative for filing (section 2), address for notifications (section 3) and consent to electronic notifications (DEHú);
- section 4.1: initial card, renewal or duplicate;
- section 4.2: your situation — initial residence, registration certificate, or temporary/permanent family member card;
- place, date, signature and, at the bottom, the authority addressed (DIR3 code and province).
What to bring
- form EX-23, original and a copy, filled in in capital letters;
- a valid passport; if it has expired — a copy of it and proof that you applied for a new one;
- the receipt for fee 790-012;
- one photo meeting Spanish DNI requirements;
- your current registration certificate or family member card if you have one, or the favourable decision of the Oficina de Extranjería; check the exact list for your case with the office.
