What this document is
“Requerimento para Apresentação de Defesa/Recurso” (CJC – No. 0160) is the official DETRAN-RJ form for defences and appeals in traffic offence cases; DETRAN-RJ is the traffic department of the state of Rio de Janeiro.
It is linked three times in the “Formulários de Infrações” section: for fines (multas), for suspension of the right to drive (suspensão) and for licence revocation (cassação da CNH). Who files it and where
- according to the form, those entitled to file a defence or appeal are: the owner, the duly identified driver, the offender, the shipper and the carrier responsible for the offence, and, for a company, its legal representative;
- a representative with a power of attorney (procuração) files it together with the representative’s identity document;
- the form is signed by hand — the same signature as on your ID, in blue or black pen — and filed with DETRAN-RJ; the clerk dates, signs and stamps the applicant’s receipt (Recibo de Requerente);
- for a defence at the notice stage (autuação), the result is sent to the vehicle owner;
- check the notice you received and detran.rj.gov.br for where to file and the deadline.
What the form asks for
- type of request: traffic offence, suspension of the right to drive, licence revocation (cassação da CNH) or other;
- type of service: defesa, 1st or 2nd instance appeal (recurso), access to the case file (vistas a processo), review of the act, prescrição intercorrente, filing of documents (juntada), review of the decision or other;
- consent (yes or no) for DETRAN-RJ to send notices, copies of offence reports and results by e-mail;
- applicant: name, social name, identity document, CPF/CNPJ, CNH, address, phones and e-mail;
- vehicle: plate (placa) and state (UF); offence report number (Auto de Infração), case number and the defence/appeal date;
- page 2: up to 20 lines of facts and arguments, place and date; the signature is handwritten.
What to bring
- from the list on the form: vehicle document (CRLV), official photo ID, the notice (Notificação) and, if you have it, the offence report (Auto de Infração);
- if a representative files — the power of attorney and the representative’s ID; for a company — a copy of the articles of association or bylaws with amendments;
- evidence for your arguments: the form requires the facts, legal grounds and/or documents proving what you state;
- originals to compare with the copies — they may be requested at any time; without the required documents the request may not be considered.
