What this document is
“Requerimento para Troca de Real Infrator” (CJC – No. 0031) is the official form of DETRAN-RJ, the traffic department of the state of Rio de Janeiro. DETRAN-RJ says to use it when the owner received the notice but another person was driving at the time of the offence.
Deadline to name the driver: the form prints 15 days (Art. 257 § 7 CTB), while the current CTB wording (Law 14.071/2020) gives 30 days from the notice; the exact deadline is stated in the notice itself (notificação da autuação). If no driver is named in time, or the nomination does not follow the rules, the owner is held responsible (Art. 6 of CONTRAN Resolution 619/2016). Who files it and where
- the applicant is the vehicle owner (or their representative); the form has two identical sections: owner and actual driver (real infrator/condutor);
- both sign — owner and driver — by hand, with original signatures and no corrections; otherwise the nomination is not accepted;
- a representative may act with a simple power of attorney to a lawyer plus the OAB card, or with a power of attorney plus a copy of the representative’s ID;
- owner and driver are criminally, civilly and administratively liable for the truth of the information;
- the form is filed with DETRAN-RJ; check where and how on detran.rj.gov.br.
What the form asks for
- for the owner and the driver alike: name and social name, identity document and issuing body, CPF/CNPJ, CNH;
- nationality and place of birth (naturalidade);
- address (street, number, complemento, CEP, state, city, neighbourhood), phone, mobile and e-mail;
- offence report number (Auto de Infração) and vehicle plate (placa);
- the date “Rio de Janeiro …/…/…” and two handwritten signatures.
What to bring
- the CNH or permissão of the owner and of the driver; an owner (or representative) without a licence brings an identity document and CPF;
- the driver’s proof of address (comprovante de residência);
- the original or a copy of the offence notice (Notificação da Autuação) or the offence report (Auto de Infração);
- if the owner is a company: a valid CNPJ, the company’s constitutive documents, ID and CPF of the representative; with a representative — the power of attorney;
- originals to compare with the copies — they may be requested at any time.
