What this document is
หนังสือมอบอำนาจ (ท.ด. 21) is the standard power-of-attorney form of the Thai Department of Lands (กรมที่ดิน). In this version the “เรื่อง” (subject) line is printed as “แบ่งให้ที่ดิน” — subdivision of land as a gift. The landowner (principal) authorises an agent to request a survey, separate part of the plot and register its gift to a named person.
The powers are already printed: requesting the survey, bringing the surveyor, placing boundary markers and certifying the boundaries, agreeing to correct the map and area if they differ from before, amending the application, registering the subdivision as a gift (จดทะเบียนแบ่งให้), paying and collecting back the remaining survey deposit, receiving the title deed (โฉนด) and making statements to the officer. The donee is written into the gap. The form is completed in Thai.
Who is involved
- the principal — the owner named on the title deed (ผู้มอบอำนาจ), who is also the donor;
- the agent — the person who goes to the land office (ผู้รับมอบอำนาจ);
- the donee — the person receiving the separated portion; named in the powers text;
- two witnesses who certify the principal’s signature or thumbprint.
If the agent is the donee or the donee’s representative, the note on the form requires adding consent that the agent acts both in their own name and for the other party.
What the form asks for
- place and date (year in the Buddhist calendar, พ.ศ.);
- plot details from the โฉนด title deed: map sheet, parcel number, survey page, title deed number, sub-district, district, province;
- name, Thai ID number, age, ethnicity, nationality, parents’ names, address and phone of the principal and of the agent;
- title and name of the donee;
- additional powers, if needed;
- signatures of the principal and two witnesses — by hand.
The area and boundaries of the separated portion are not stated in the power of attorney — they are set during the survey and in the application at the land office.
What is usually attached
- the original title deed (โฉนดที่ดิน);
- copies of the principal’s ID card and house registration, signed by the principal;
- the agent’s ID card or passport;
- if needed — marital status documents or spouse consent, documents of the donee.
The exact list, the survey deposit, fees, taxes and timing are not stated on the form — check with the land office (สำนักงานที่ดิน) where the plot is registered. Under Thai law a foreigner generally cannot acquire land, including by gift — check this in advance.
