What this document is
This is the power of attorney form (หนังสือมอบอำนาจ, form T.D. 21) of the Thai Department of Lands (กรมที่ดิน) with the printed subject “ภาระจำยอม” — servitude. With it the landowner (principal) authorises another person (agent) to register a servitude at the Land Office and to give statements to the officer on their behalf.
The printed powers text states that the plot in the header of the form is registered as the “สามยทรัพย์” (the plot that benefits from the servitude) for a servitude of the stated kind in relation to another titled plot in the same sub-district and district, with or without compensation. If the principal’s plot is instead the one burdened by the servitude, check with the Land Office whether this wording fits.
Who fills it in and where it is filed
- principal — the landowner named on the title deed (โฉนด);
- agent — the person who attends the Land Office instead of the owner; this may also be the owner of the other plot or their representative;
- the power of attorney is filed at the Land Office (สำนักงานที่ดิน) where the land is located, when the servitude is registered;
- it is signed by the principal and two witnesses; if the agent is the other party or represents it, the form’s note requires a consent clause.
What the form asks for
- land details from the title deed: map sheet (ระวาง), parcel number, survey page, title deed number, sub-district, district, province;
- place and date of signing, year in the Buddhist Era (B.E.);
- principal and agent: name in Thai script, age, ethnicity, nationality, parents’ names, address per house registration, telephone;
- kind of servitude (e.g. ทางเดิน — footpath), title deed number of the other plot;
- whether there is compensation, and its amount in figures and words;
- the Thai ID number is written by hand in the boxes; signatures by hand.
What is usually attached
- the original title deed (โฉนดที่ดิน) of the plot;
- signed copies of the Thai ID card (or passport) and house registration of the principal and the agent;
- if the principal is married, spousal consent may be required;
- a sketch of the servitude area if the office asks for one.
The form does not list all attachments, fees or processing times — check with the Land Office where the land is located.
How to fill it in with FoxDocs
