What this document is

This is the Thai Department of Lands (กรมที่ดิน) power of attorney form Tor Dor 21 with the subject “ขายฝากที่ดินเฉพาะส่วน” printed on it — a sale with right of redemption of a share in a plot of land. A co-owner (the principal) authorises another person (the attorney) to complete the transaction at the land office on their behalf.

In a sale with right of redemption (khai fak) the seller transfers the share to the buyer but may buy it back for an agreed amount (sin thai) within a set period. For immovable property the law allows at most 10 years. The form is for land held under a chanote (โฉนดที่ดิน).

Who fills it in and where it is filed

  • the principal — the co-owner whose share is being sold;
  • the attorney — the person who goes to the land office and signs the transaction; this may be the buyer or the buyer’s representative, in which case the form requires a special clause (see FAQ);
  • the power of attorney is presented at the land office (สำนักงานที่ดิน) where the land is registered;
  • it is signed by the principal and two witnesses; a left thumbprint may replace the signature, and the option not used is struck out.

What the form asks for

  • land details from the chanote: map sheet (ระวาง), land number, survey page, deed number, sub-district, district, province;
  • the redemption period in years, the sale price and the redemption price in figures and in words;
  • buildings sold with the land, if any: type, storeys, number, house number;
  • principal and attorney: title and name, Thai ID, age, ethnicity, nationality, parents’ names, address, phone;
  • the buyer: title and name;
  • place and date (year in the Buddhist Era, พ.ศ.).

Documents usually attached

  • the original chanote;
  • copies of the ID cards and house registration books (ทะเบียนบ้าน) of the principal and the attorney;
  • if the principal is married, spousal consent may be required.

The form does not list the attachments, fees or processing times — check them with the land office.

What is this power of attorney for?

How is “khai fak” different from an ordinary sale?

The seller keeps the right to buy the share back for an agreed amount (sin thai) within a set period. For immovable property the period cannot exceed 10 years.

Can the buyer be the attorney?

Yes. The note on the form then requires the clause “และยินยอมให้ผู้รับมอบอำนาจเข้าทำการแทนในนามตนเองและ/หรือเป็นตัวแทนของอีกฝ่ายหนึ่งด้วย”. FoxDocs writes it in the blank lines if you say so.
