What this document is
หนังสือมอบอำนาจ (ท.ด. 21) is the standard power of attorney form of Thailand’s Department of Lands (กรมที่ดิน). This version has the subject “แลกเปลี่ยนที่ดิน” — exchange of land — printed on it. With it the landowner (principal) authorises another person (agent) to exchange the plot for another plot with a โฉนด title deed at the Land Office: file the application, give statements to the officer and sign until registration is completed.
The header records the principal’s land as shown on the title deed: map sheet, land number, survey page, deed number, sub-district, district and province. The powers text names the building on the land (if exchanged with it), the deed number and location of the other plot, and whether there is an additional payment and how much. The form is filled in in Thai.
Who makes it
- the principal — the landowner named on the title deed (ผู้มอบอำนาจ);
- the agent — the person who goes to the Land Office (ผู้รับมอบอำนาจ);
- two witnesses who certify the principal’s signature or fingerprint.
If the agent is the other party to the exchange or represents it, the note on the form requires adding consent that the agent acts both in his or her own name and on behalf of the other party.
What the form asks for
- place and date (year in the Buddhist Era, พ.ศ.);
- the principal’s land details from the โฉนด title deed;
- name, Thai ID number, age, race, nationality, parents’ names, address and phone of the principal and of the agent;
- the building on the land (house, building or shophouse, storeys, house number) — if exchanged together with the land;
- deed number, sub-district, district and province of the other plot;
- with or without an additional payment, its amount in figures and in words;
- signatures of the principal and two witnesses — by hand.
What is usually attached
- the original title deed (โฉนดที่ดิน) of the principal’s plot;
- copies of the principal’s ID card and house registration, signed by the principal;
- the agent’s ID card or passport;
- if needed — marital status documents or the spouse’s consent.
The exact list, fees, taxes and processing times are not stated on the form — check with the Land Office (สำนักงานที่ดิน) where the land is registered. Under Thai law a foreigner generally cannot acquire land ownership, including by exchange; check this in advance.
